    Extract:

    The Tribunal has consistently held that staff promotions by an international organisation are decisions which lie within the discretion of its executive head. Such a decision is therefore subject to only limited review by the Tribunal, which will interfere only if the decision was taken without authority, if a rule of form or procedure was breached, if it was based on a mistake of fact or of law, if an essential fact was overlooked, if a clearly mistaken conclusion was drawn from the facts, or if there was abuse of authority (see, for example, Judgments 2834, under 7, 3006, under 7, or 3742, under 3).

    Consideration 11

    Extract:

    The setting aside of this decision does not, in itself, imply that the complainant would actually have been promoted if the proper procedure had been followed. Nevertheless, as her immediate supervisor had submitted a very complimentary promotion proposal, which would normally have been supported by her second-level supervisor, the procedural flaw identified above unduly deprived her of a promotion opportunity. This lost opportunity constitutes material injury which, as the complainant rightly submits, entitles her to compensation (see, for example, Judgments 2869, under 10, or 3084, under 21).

    Extract:

    The Tribunal’s case law, as recalled in Judgment 2682, under 6, establishes that “an acquired right is breached only when [...] an amendment adversely affects the balance of contractual obligations by altering fundamental terms of employment in consideration of which the official accepted an appointment, or which subsequently induced him or her to stay on. In order to determine whether there has been a breach of acquired rights, it is therefore necessary to ascertain whether the altered terms of employment are fundamental and essential within the meaning of Judgment 832”. This case law was confirmed in Judgment 3074 (under 15 and 16).
    It is well settled that the particular arrangements for the grant of promotion confer no acquired rights, because on recruitment staff cannot foretell how they will fare in their career. An organisation may always change the rules on promotion for the sake of efficiency and so as to cope with changing circumstances. (See Judgment 1025, under 4.)

    "As the Tribunal has already held in a similar case involving Eurocontrol and another official, while every official should have some prospect of advancement within an organisation and may therefore legitimately hope to move up to a higher position one day, there is no automatic right to promotion. This right is limited, on the one hand, by the official’s seniority, qualifications, skills and performance and, on the other, by the Organisation’s administrative structure and budgetary resources (see Judgment 3404, under 8, and the case law cited therein)."

    The Tribunal holds that, while every official should have some prospect of advancement within an organisation and may therefore legitimately hope to move up to a higher position one day, there is no automatic right to promotion. This right is limited, on the one hand, by the official’s seniority, qualifications, skills and performance and, on the other, by the Organisation’s administrative structure and budgetary resources (see Judgments 526, under 4, 3279, under 11, and 3280, under 7, and the case law cited therein).
