    European Organisation for the Safety of Air Navigation
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 10

    Extract:

    The Reports Committee, which was called on to advise on whether the complainant's appointment should be confirmed, is free, as is the Tribunal, to turn down a complainant's request for hearings in the absence of any procedural rule to the contrary. "There was no breach of due process: provided that both parties were given the opportunity to state their views - and they were - the Reports Committee was free to conduct its inquiry as it thought fit."

    Keywords:

    adversarial proceedings; advisory body; due process; oral proceedings; procedure before the tribunal;

    Food and Agriculture Organization of the United Nations
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Keywords:

    oral proceedings; refusal; tribunal;

  • Judgment 619

    53rd Session, 1984
    Food and Agriculture Organization of the United Nations
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 1

    Extract:

    "By virtue of Article V of its Statute the Tribunal decides in each case whether oral proceedings shall be public or in camera. But its practice is to order such proceedings only in exceptional circumstances where evidence from the parties or witnesses may help in resolving the issues."

    ILOAT reference: ARTICLE V OF THE STATUTE

    Keywords:

    exception; oral proceedings; purpose;

  • Judgment 579

    51st Session, 1983
    World Health Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 2

    Extract:

    "The grounds upon which the complainant seeks review, viz. the error of his being placed by the Selection Committee in [a particular category], the failure of the Selection Committee to screen his case properly and the refusal of the Tribunal to summon witnesses whom the complainant did not call at the hearing by the [Internal Appeal Board], are not grounds for review."

    Keywords:

    application for review; inadmissible grounds for review; misinterpretation of the facts; oral proceedings; refusal; tribunal;

  • Judgment 511

    49th Session, 1982
    Food and Agriculture Organization of the United Nations
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 3

    Extract:

    There is no substance to the complainant's plea that her right to a hearing was ignored. Her right to reply in writing was recognised and confirmed on two occasions. The time limit, though short, was adequate: the complainant did not need a long time to answer the charges, which were nothing new. She could have had the time limit extended. "It is immaterial that she was asked to reply in writing and not orally. Unless there is a provision to the contrary, the right to a hearing does not denote any right to reply orally."

    Keywords:

    disciplinary measure; oral proceedings; right to reply;

  • Judgment 377

    42nd Session, 1979
    International Labour Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Considerations

    Extract:

    The Committee carried out a complete review of the complainant's case and thereby did what the Director-General asked it to do; it was empowered to dismiss as pointless or immaterial the complainant's applications for an inquiry and for the hearing of witnesses; its report answers all the arguments and adequately bears out its conclusions. There is no evidence of any procedural flaw.

    Keywords:

    complainant; inquiry; internal appeals body; investigation; oral proceedings; refusal; request by a party;

  • Judgment 280

    37th Session, 1976
    Food and Agriculture Organization of the United Nations
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 2

    Extract:

    "In the present case the Tribunal can exercise its power of review in the light of the documents produced in the proceedings. There is therefore no need to hear witnesses, as the complainant has asked."

    Keywords:

    oral proceedings; refusal; tribunal;

  • Judgment 236

    32nd Session, 1974
    International Labour Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 2

    Extract:

    "It has for many years past been the practice of the Tribunal to allow oral proceedings only in exceptional cases [...] The argument which the complainant wishes to advance at an oral hearing [does] not touch upon the issue of receivability upon which [...] the Tribunal decides this case. The request is therefore refused."

    Keywords:

    exception; oral proceedings; refusal; tribunal;

  • Judgment 232

    32nd Session, 1974
    United Nations Educational, Scientific and Cultural Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Considerations

    Extract:

    The appeals body "was free to determine whether it had enough information at its disposal and whether or not in establishing the truth it would serve any purpose to hear witnesses in the course of proceedings which by their very nature should be and are mainly written."

    Keywords:

    adversarial proceedings; internal appeals body; oral proceedings; refusal;

  • Judgment 133

    21st Session, 1969
    United Nations Educational, Scientific and Cultural Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 1

    Extract:

    The complainant produced a number of resolutions demonstrating the reactions of the staff to the measures taken; "the organization asks the Tribunal to rule on the admissibility of these documents", alleging that their production would constitute intervention by the staff association. "However [...] the documents in question [are] in no way improper; they are no more capable of influencing the Tribunal's decision than any of the other evidence submitted. They must be regarded as written evidence rather than as the statement of one of the parties or its representative. There is no cause to exclude them from the dossier."

    Keywords:

    admissibility of evidence; appraisal of evidence; disclosure of evidence; oral proceedings; testimony;

  • Judgment 121

    20th Session, 1968

  • Judgment 115

    18th Session, 1967
    World Meteorological Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 1

    Extract:

    "At the request of [the] complainant [...], the Tribunal ordered [the witness to] be heard [...] and [the complainant's] personal file [to be disclosed]. The Tribunal considered, however, that the delivery of [the] complainant's medical file and of a document concerning events subsequent to the filing of the complaint was unnecessary for the disposition of the case."

    Keywords:

    appraisal of evidence; disclosure of evidence; oral proceedings; personal file; request by a party; subsequent fact; testimony; tribunal;

  • Judgment 82

    14th Session, 1965
    International Telecommunication Union
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Consideration 4

    Extract:

    The interveners submitted a document on 2 April. On 10 April the judgment was delivered, after the public hearing of 6 April. Applications to intervene may be made at any stage; "that does not necessarily mean that interveners are entitled to invoke up to the day of the proceedings any facts, evidence and new documents. [The material document] deals solely with points of law and raises no new points. Consequently [...] the organisation, [which] learned of this legal opinion three days before the oral proceedings began, has been able usefully to discuss the arguments and the conclusions. The [adversarial] procedure has thus been [followed]".

    6th Session, 1957
    International Labour Organization
    Extracts: EN, FR
    Full Judgment Text: EN, FR

    Considerations

    Extract:

    "The hearing of the witness called by the Tribunal on the request of the complainant as a result of which the complainant purported to show that there was a concerted hostile attitude of a political nature against him, has not resulted in any such proof but has only shown that certain frivolous and slanderous allegations were brought in issue, while no misuse of authority has been proved."

    Keywords:
