Workshop on Improving the Legislation System on Labour, Employment and Social Security In Associated With The Implementation Of Constitution 2013 In The Context Of The Trans - Pacific Partnership

The workshop is organized by the Committee for Social Affairs, National Assembly, in coordination with the ILO Country Office for Viet Nam.

One of the fundamental missions in implementing the Constitution 2013 when it comes into force is the review and evaluation of the current legislation system, which aims at clarifying the conformity of each legal normative act with the new regulations of the Constitution in order to produce corresponding measures to ensure the effectiveness and validity of the Constitution. The urgent comprehensive review of the legal documents issued by the central and local departments is to unveil the regulations against the Constitution, which needs to be halted, revised, supplemented, abolished or renewed so as to concretize the new regulations of the Constitution in general and the regulations of the legislation system on labour, employment and social security in particular, especially in the context of Viet Nam joining the ASEAN Economic Community (AEC), Trans – Pacific Partnership (TPP) and other new generation free trade agreements (FTAs).

Apart from bettering the legal system in response to the new requirement of Constitution 2013, its compatibility to the international law and Viet Nam’s commitments under the TPP and other new generation FTAs bears a very critical importance and complexity, which needs to be scientifically implemented with an appropriate road map that would mobilize intelligence and experiences of the whole society and international organizations, etc. contributing to the improvement of every draft legal document before the approval of the National Assembly and relevant authorities.

In order to prepare for the consultations and approval of TPP by the National Assembly in its coming Congress term XIV, the Committee for Social Affairs of the National Assembly in coordination with the ILO Country Office for Viet Nam is organizing the workshop “Improving the legislation system on labour, employment and social security in associated with the implementation of Constitution 2013 in the context of the Trans-Pacific Partnership (TPP)”

Objectives

The main objectives of the workshop are to:
  • Present an overview of Viet Nam’s legislation system improvement in the areas of labour, employment and social security under Constitution 2013 and orientation for better improvement in association with the commitment of Viet Nam in global integration;
  • Evaluate the situation of industrial relations in Viet Nam and the orientation of the improvement of the legal regulations on industrial relations so as to maximize the initiatives and capacity of the actors in the mechanism of dialogues, negotiation and labour dispute resolution;
  • Present some requirements to the law system of Viet Nam with regard to labour and union in TPP and proposals for improvement.

Participants

The Committee for Social Affairs – National Assembly, Representatives from ILO Country Office for Viet Nam, Ministry of Labour, Invalids and Social Affairs, Vietnam General Confederation of Labour, Viet Nam Chamber of Commerce and Industry, Viet Nam Social Security, business associations, representatives from the delegations of the National Assembly’s deputies, provincial authorities of Da Nang and provinces in the Central Viet Nam and enterprises.
