    The Act was designed to provide a practical and accessible process to raise and consider claims of systemic sex-based pay undervaluation in female-dominated occupations. In certain occupations where the work is, or was predominately performed by females, wages have been kept lower than occupations where the work has been performed predominately by men. It seeks to address inequality in wages arising out of the “going market rate” for employing people in those traditionally female dominated occupations not being a fair or equal rate, but a suppressed wage born out of historical pay discrimination.

    New Zealand’s equal pay law provides that women and men should be paid the same for jobs of equal value, even if the jobs are different. Until now, workers have only been able to make claims for pay equity through the courts. The Equal Pay Amendment Act allows workers or unions to make a pay equity claim directly with their employer using a framework that is similar to New Zealand’s existing employment relations bargaining framework. By making court a last-resort, the proposed approach will lower the bar for workers or unions to raise a pay equity claim, and use a collaborative process
    more familiar to unions and businesses.

    Under the Act, employers, workers and unions will negotiate in good faith, with access to mediation and resolution services available if they are unable to agree.

    The Amendment will take effect in late October 2020.

    The Act implements into law the settlement agreement signed on 2 May 2017 by or on behalf of the Crown, ACC, the 20 District Health Boards, E tū Incorporated, the New Zealand Public Service Association Te Pūkenga Here Tikanga Mahi Incorporated, the New Zealand Nurses Organisation Incorporated, and the New Zealand Council of Trade Unions Te Kauae Kaimahi Incorporated. The agreement relates to pay equity issues for care and support workers.

    The regulations replace the Parental Leave and Employment Protection (forms) Regulations 1987. They prescribe information relating to applications for paid parental leave, such as the manner in which applications must be made and the information that employees and employers must give as well as the way in which annual adjustments of the maximum rate of paid parental leave will be made. The annual adjustments are in accordance with any percentage movement upwards in average ordinary time weekly earnings (employees), as determined in the Quarterly Employment Survey published by Statistics New Zealand. They also prescribe a new form of demand notice that may be used by Labour Inspectors under new section 70B of the Act.

    An Act to consolidate and amend the Race Relations Act 1971 and the Human Rights Commission Act 1977 and to provide better protection of human rights in New Zealand in general accordance with United Nations Covenants or Conventions on Human Rights

    The Human Rights Act 1993 protects people in New Zealand from discrimination in a number of areas of life. Discrimination occurs when a person is treated unfairly or less favourably than another person in the same or similar circumstances. The Human Rights Act lists the areas and grounds where discrimination is unlawful and also some exemptions or exclusions.     The Human Rights Amendment Act 2001 made significant changes to the Human Rights Act 1993. The Human Rights Act comprises eight parts.

    The Act assess the minimum level of financial support payable by certain parents in respect of their children. Provides for the collection and payment of child support and spousal maintenance payments. Makes transitional arrangements relating to maintenance liabilities under the Social Security Act 1964 and the Family Proceedings Act 1980.
