Stage 2: State of Emergency - Covid-19 Regulations: Namibian Constitution (Proclamation No 17 of 2020). - Adoption: 2020-05-04 | Date de fin d'application: 2020-06-01 | NAM-2020-R-110038 Inter alia, defines “vulnerable employee” as expecting mothers, nursing mothers, employees with pre-existing conditions such as a heart disease, high blood pressure, respiratory problems, obesity, diabetes, tuberculosis or a condition which might compromise the immune system of the employee.
The regulations also set out additional provisions relating to workplace
9. (1) Heads of institutions are encouraged to allow vulnerable employees to work from home, subject to suitable arrangements between the employer and employee.
(2) Heads of institutions are encouraged to provide masks to their employees.
(3) Heads of institutions must ensure that their employees at all times adhere to the measures to combat, prevent and suppress the spread of COVID-19 as specified in and under these regulations.

Further provisions effecting the Labour Act, 2007 concerning inter alia, unpaid leave, remuneration and dismissal. Provides that if the employer wishes to reduce remuneration, they must negotiate with a recognised trade union; a workplace representative; or in the absence of a recognised trade union or workplace representative, the affected employee or employees. The agreement must be filed with the Labour Commissioner, or if not agreement is reached, any party may refer the dispute to the Labour Commissioner.

Namibia Legal Environment Assessment of HIV and AIDS, 2016. - Adoption: 2016-03 | NAM-2016-M-110800 The aim of the legal and regulatory analysis is to improve the availability of information and evidence of legal and regulatory aspects in the context of HIV and AIDS, for purposes of making recommendations for creating and strengthening an enabling environment that promotes an effective national AIDS response in accordance with the Republic of Namibia’s National Strategic Framework 2010/11-2015/16 and the National Policy on HIV. The assessment has been conducted by way of a desk review of documentation on selected laws, regulations and policies and a qualitative assessment of the level of knowledge on human rights among key and vulnerable populations; and of the degree of awareness of HIV related laws and human rights among law makers and law enforcers to enable effective implementation of services, access to justice and enforcement of HIV-related laws and rights.
