    Establishes a basic state structure of three branches, with a strong executive, based on the principles of democracy, rule of law and separation of powers. Section 1 addresses the rights, freedoms and duties of citizens. Citizens are guaranteed equal rights, and protected against internationally recognized prohibited discriminations. Echoing the broadly framed rights found in the two UN Convenants on Civil and Political Rights and on Economic, Social and Cultural Rights, these include the right to life and freedom of speech, religion and residence. Rights of a political nature (e.g., right to vote, to assemble, to associate), economic (e.g., right to work, to good working conditions, to strike) and social (right to rest, to housing, to health protection, and to education) are found in Articles 14 to 27. Trade unions are permitted under Article 57.

    Law of 4 July 1992 on Collective Agreements.

    Adoption: 1992-07-04 | KAZ-1992-L-42939

    Comprises of 11 articles. States that Parties to the agreement (the owner and the workers as a whole) shall have equal rights in the working out of the agreement. The workers are represented either by the general assembly of workers, by a trade union or by any other empowered body. The agreement shall establish, inter alia, the wage payment system, the working conditions and the specific benefit scheme. It shall not limit the workers' rights as defined by the national legislation. Available in French.

    Agreement on guarantees of rights of citizens of participant States of the Commonwealth of Independent States in the sphere of pension provisions concluded in Moscow on 13 March 1992.

    Provides for the protection of pensions of citizens of participants States of the Commonwealth of Independent States and their families, including military servicemen of the armed forces. English translation available.

    Provides for general conditions to receive Kazakh citizenship and fixes cases of loss of citizenship, citizenship of children when parents change citizenship and in case of adoption, State organs in charge of citizenship questions and their tasks, claims and international agreements.

    Trade unions shall be considered as public associations (art. 1). In their relations with State bodies and cooperatives, they shall represent the interests of workers (art. 8).

    Law of 11 December 1990 on freedom of economic activity and development of private enterprise.

    Defines who may engage in entrepreneurial activity and requirements to be met by entrepreneurs (registration of enterprise). Provides that private entrepreneurs and public enterprises be guaranteed equal rights, inter alia in terms of access to financial and labour markets. Chapter III governs labour relations and employment conditions. Collective agreement shall not contradict national legislation. Workers shall be guaranteed a minimum wage as well as social security.

    Law of 7 December 1990 on foreign investments.

    Chapter II, dealing with activities of foreign owned enterprises, provides for rules to be followed with regard to conditions of work and employment, and labour relations. States that conditions of work and employment shall not be less favourable than in national enterprise. Labour relations shall be regulated by collective agreement and individual labour contracts. Labour disputes relating to hiring or dismissal shall be dealt with at the enterprise level.
