Law No. 212-V ZRK of 27 June 2014 to Amend and Supplement Several Legal Acts of the Republic of Kazakhstan on the Issues of the Activity of Trade Unions and Regulation of Labor Relations. -

Amends, inter alia, Labor Code: namely repeals the title of article 230; supplements the code with article 230-1 (Registries of the posts of civil servants), chapter 28-1 (Peculiarities of the regulation of the employment of workers), article 257-2 (Regulation of the employment of workers that are part of trade union bodies), article 328-1 (Visitating of the subject of control), article 328-2 (Departmental registration); rephrases article 268 and its title which now reads as follows: "Main purposes, tasks and functions of republican, branch and regional commission"; changes the wording of para 60 article 1 (Main categories used in this code); supplements article 1 with sub-paragraphs 69-1) and 73-1); repeals sub-paragraph 11 of article 15 (Competency of the Government of the Republic of Kazakhstan in the field of regulation of labor relations) supplementing the same article with sub-paragraphs 14-1), 25-1); rephrases article 16 (Competency of authorized state body of labor in the field of regulation of labor relations) supplementing it with sub-paragraphs 7-1), 7-2), 17-1), 25-1); rephrases para 1 of article 28 (Content of employment contract), article 53 (Termination of employment contract by the end of employment period), paras 2 and 3 of article 117 (Development, replacement and revision of labor norms in effect and introducing of new ones), articles 276 (Content of agreements), 278 (Effect of agreements), 292 (Arbitral commission), 319 (Adoption of normative acts in the field occupational safety and protection); also supplements articles 264 (Organization of social partnership on the branch level), 265 (Organization of social partnership on the regional level), 340 (Public control over the implementation of labor legislation in an organization), 341 (Rights of public inspectors of labor protection) with new paras; introduces minor wording changes to articles 122, 124, 138-3, 138-4, 149, 171, 172, 185, 195, 282, 284, 295, 297, 328.
Part 2, 3, 4 of sub-paragraph 1) of para 2, Part 2 of sub-paragraph 3) of para 2, part 7 of sub-paragraph 4 of para 2, sub-paragraph 19), 20) of para 2, para 3 enter into force on 1 July 2015.

Also amends:
- The Code of Civil Procedure of the Republic of Kazakhstan dated July 13, 1999 year (Bulletin of the Parliament of the Republic of Kazakhstan, 1999, No.18); and
- The Law On State award of the Republic of Kazakhstan dated December 12, 1995 (Bulletin of the Supreme Council of the Republic of Kazakhstan 1995, No. 23).

In accordance with the legislation on enrollment of foreign workforce in employment in the Republic of Kazakhstan, establishes the terms of admission of foreigners and of persons without citizenship to work on ship, namely stipulating the terms of appointment to certain positions, the level of professional training and work experience, and the required documents for admission to work.

In accordance with the law on Compulsory Social Insurance, increases by 4,59 % the size of social payments from state social insurance fund in cases of working disability and loss of breadwinner to persons receiving social payments as of 1 April 2014.

This Law regulates public relations arising upon failure of the debtor to satisfy requirements of the creditors in full, establishes the grounds for applying accelerated rehabilitation procedure, rehabilitation procedure and declaration of the debtor as a bankrupt, as well as determines the procedure and conditions of conducting the procedures of rehabilitation and bankruptcy.

Amends a number of legislative texts including the Labour Code introducing new wording to para 1 of article 26 (restrictions of concluding employment contract) and supplementing it with para 1-1 prohibiting the conclusion of employment contract by an employer with more than five labor migrants at the same time for works at home; also rephrasing para 1 of article 29 (duration of employment contract) and supplementing it with subparagraph 6 concerning the official permission to use foreign labor force, changing the wording of articles 31 (documents needed to conclude employment contract), 214 (peculiarities of conclusion and termination of employment contract with workers at home).
