    Based on the UN Convention on the Rights for Persons with Disabilities that was ratified by the Government of Indonesia in 2011, the law sees the rights of persons with disabilities as inseparable from the equal rights of all members of the human family, including the access to employment opportunities. The Law No. 4 of 1997 concerning Persons with Disabilities is repealed upon entry into force of this Law.

    Implements Art. 38 of the Act No. 13 of 2003. Article 4 provides that recruitment agencies may charge fees from employers as well as workers recruited for certain jobs and occupations. Article 5 lists these as managerial, supervisory, operational positions, and jobs requiring professional qualifications with the minimum requirement of a bachelor degree plus professional education. The positions are to receive no less than three times the locally applicable wage. The amount of the fee to be paid is to be agreement on between the recruitment agency and the worker but is not to exceed one month's wages to be paid in no less than five instalments (Article 7).

Chapter II deals with Indonesia's manpower service company, Chapter III with the implementation of placement, Chapter IV with placement by government agencies, state enterprises and private companies, and Chapter V with individual placement. Chapter VII provides for the promotion, control and evaluation of placement.

    Chapter I of the Regulations contain General Provisions. Provides that every workers with a disability should be provided with equal opportunities and treatment with respect to employment. Employers are obliged to provide employment opportunities to workers with disabilities.

    Chapter II provides measures for job training and vocational rehabilitation. This is to be organized by Government vocational training institutes.

    Chapter III provides for the placement of workers with disabilities. Recruitment services may be provided either by the Government or private agencies.

    Chapter IV deals with supervision of the implementation of the Regulations. This shall be done through the existing Labour Inspection laws and regulations.

    Chapter V concerns the closing provisions.

    This Decree establishes the Agency for Coordination and Control in Generating Social Welfare for Persons with Disabilities (LKP2KS) in order to replace the Team Coordinating Social Welfare Efforts Persons with Disabilities (Tim Koordinasi Usaha Kesejahteraan Sosial Penyandang Cacat) established under Presidential Decree No. 39 of 1983. The primary role for the management of this Agency is the Ministry of Social Affairs (Kementerian Sosial Republik Indonesia). Other Ministries, (in particular the Ministry of Manpower) as well as the Employers' organization, the Indonesian Association of Disabled Persons (Persatuan Penyandang Cacat Indonesia (PPCI)) are members of the Agency. The Agency's role is to:
    - formulate and implement policy and coordinate program efforts to improve the social welfare of persons with disabilities;
    - conduct research, assess, monitor, evaluate, and control public policy and program efforts to improve the social welfare of persons with disabilities;
    - implement collaboration with international agencies or bodies;
    - reception, research, and study recommendations and considerations.

    It also establishes a Directorate for Persons with Disabilities within the Ministry of Social Affairs.

    Implements articles 70-73 of Government Regulation No. 43/1998 concerning efforts to improve social welfare for persons with disabilities. It is based on Law No. 6 of 1974 on Basic Provisions of the Social Welfare (repealed by Social Welfare Law (No. 11/2009)) as well as Law No. 22 Year 1999 on Regional Government.

    All recruitment of workers, domestically or overseas, is regulated. Public recruitment entities must have an approval (SPP) by the appropriate ministry and private entities must have a license (SIUP-PJTKI). The regulations prescribe the procedure to obtain a SPP and a SIUP-PJTKI. A private entity seeking a SIUP-PJTKI must have a paid up capital of 375,000,000 rupiahs for a general recruitment license and 200,000,000 rupiahs for a domestic recruitment license. The approved and licensed entities are entitled, inter alia, to collect charges both from potential employers and workers, and are required, inter alia, to provide potential workers with certain vocational training at specifically designated Job Training Insitutes.
