    Law N° 4057/2012: Disciplinary Law of Public, Political and Administrative Employees and Employees of Public Entities. - Text in Greek

    Article 1 replaces Chapter VI of Part 4 of the Code of Conduct of Public Administrative Employees (Law N° 3528/2007), regarding the suspension of exercise of duties.
    Article 2 replaces Part 5 of the Code of Conduct of Public Administrative Employees (Law N° 3528/2007) concerning Disciplinary Law, regulating disciplinary offenses and penalties (Section 1), the disciplinary investigation (Section 2) and the Disciplinary Boards (Section 3).
    Article 3 makes a number of amendments to the Laws N° 4024/2011, 3528/2007, 3839/2010 concerning the selection of the heads of departments.
    Articles 4 and 5 extend the scope of the present Law (N° 4057/2012) to the Public Personnel and the Personnel of Public Entities functioning under a private law employment relationship and holding an organic position, as well as to the municipal permanent personnel and the personnel of the municipal Public Entities.
    Article 6 adjusts disciplinary issues of the educational personnel and of any other personnel falling under the jurisdiction of the Ministry of Education and Religion.
    Article 7 and 8 provide respectively the transitive provisions and the provisions to be repealed.
    Article 9 regulates issues of competence of the Ministry of Administrative Reform and E-Governance.

    Presidential Decree No.40 of 2007, regulating the measures for protection of employees in case of lack of insolvency of the employer.

    It adapts the national legislation to the Directive 2002/74/EC of the European Parliament and of the Council.
    In article 1, it refers to cases of bankruptcy of the employer. In the last paragraphs of the article 1 it mentions also the part-time workers. Finally, in article 5, it is stipulated the conditions for issuing state financial aid to the victims of the employers insolvency.

    Ne s'applique pas aux navires naviguant en mer. Prévoit que tous les droits des travailleurs de l'entreprise transférée au nouvel employeur restent intacts. Contient notamment des dispositions sur l'assurance et la sécurité sociale et la représentation des travailleurs. Précise que ces dispositions n'empêchent pas les licenciements pour des raisons économiques, techniques ou d'organisation interne de l'entreprise. Prévoit en outre l'obligation pour l'employeur d'informer et de consulter les travailleurs sur tout changement et conséquence résultant du transfert.

    Undertakings falling within the scope of Law 2961/1954 may terminate their employees¿ employment relationships, but are under an obligation to pay compensation in the event of termination without prior warning (article 1). The compensation owed according to Law 2112/1920 to employees who have been dismissed without a time limit shall be payable by the employer at the date of termination of the employment relationship (article 2). If the employer determines a period of time, at the end of which the termination of the employment relationship will be effected, s/he shall pay to the dismissed employee at the expiry of that period of time a compensation equal to half of that owed in the event of termination without prior warning (article 4). The compensation shall be calculated on the basis of the regular earnings of the employee on the last month of full time employment (article 5).

    Les articles 33 à 43 prévoient des mesures visant à assurer la protection des travailleurs des entreprises qui connaissent des difficultés financières. Une prime sera allouée aux employeurs qui engagent des travailleurs licenciés pour motif économique (art. 34). Un fonds spécial est créé pour le financement des programmes de réintégration dans la vie professionnelle et d'emploi des travailleurs des entreprises en difficulté (art. 35). La durée de l'allocation-chômage est prolongée (art. 37). Des dispositions sont prises en matière d'emploi à temps partiel (art. 38) et de sécurité sociale pour les travailleurs à temps partiel. Les conventions collectives de travail ainsi que des accords entre l'employeur et le conseil des travailleurs peuvent autoriser, pour une période de trois mois au maximum, l'augmentation de la durée du travail (jusqu'à 9 heures par jour et 48 heures par semaine) pour autant que celle-ci soit ensuite diminuée dans la même proportion. Des dispositions fixent les heures d'ouverture des magasins, et les heures de travail des employés, et d'autres visent le lien entre la rémunération et la productivité (cf. loi no. 1731 de 1987, journal officiel, No. 161).

    Ce texte vise à harmoniser la législation grecque avec celle des Communautés Européennes, et en particulier avec les dispositions de la directive du Conseil du 14 février 1977 (77/187/CEE). les points principaux sont les suivants: droits et obligations du cédant et du nouveau propriétaire; respect des contrats collectifs; droit des travailleurs à la sécurité sociale; changement des stipulations du contrat de travail; résiliation du contrat; protection des représentants des travailleurs; justification des décisions et consultation avec les travailleurs; sanctions.

    The present law regulates matters concerning collective redundancies he issue of group dismissals. Collective redundancy shall mean any dismissal effected by undertakings or establishments employing more than twenty (20) employees for reasons not relating to the employee him/herself and exceeding a specific number every calendar month (article 1).

    Prior to engaging in collective redundancies, the employer shall consult with the representatives of the employees, in order to explore the possibility of avoiding or reducing these dismissals and their adverse effects (article 3).

    For the purposes of these consultations, as representatives of the employees shall be considered the legal representatives of the association of the employees of the undertaking or establishment, which has as members at least seventy per cent (70%) of the latter¿s employees, as well as the majority of those dismissed (article 4). The time limit within which the consultations between the employer and the employees shall take place is twenty (20) days and commences pursuant to a relevant invitation of the employer to the representatives of the employees. The outcome of the consultation procedure shall be noted in a minute, which will be signed by the parties and submitted by the employer to the Prefect or the Minister of Employment (article 5).

    The obligation to terminate employment contracts of employees working under private law, according to Law 2112, shall apply henceforth to all categories of workers, technicians and servants (article 1) and shall concern only employment contracts and not work contracts (article 2). Accordingly, a termination of an employment contract shall be valid only if it is notified by the employer to the employee at least five (5) days before it is effectuated (article 3). Any employer who fails to fulfil the aforementioned obligation shall pay to the dismissed employee as compensation an amount equal to the total of the regular salary or wages in general, which s/he would receive for employment during the working days, prior to which the termination should have been notified (article 5).
