The other scheme, which applies to persons who are required to attend other offices listed in the Schedule, modifies the regulations on availability, active jobseeking and sanctions for full-time students. Also provides for full-time students to whom the Regulations apply to be treated in the same way as students for the purpose of entitlement to housing benefit and council tax benefit.

Makes provision in the Attendance Allowance Regulations so that a person awarded attendance allowance or disability living allowance may be required to submit to a medical examination , and where he fails without good cause to do so, for benefit to be withheld. Makes provision in the Adjudication Regulations to enable the adjudication officer to treat failure to attend for, or submit to, a medical examination in attendance allowance and disabilty living allowance cases as a relevant change of circumstances.

The principal changes oblige the person who makes the compensation payment (the compensator) to repay to the Department of Health and Social Services the total amount of the recoverable benefits. The changes also make benefits deductible by the compensator only from damages awarded for analogous reasons, and declare damages for pain and suffering protected from benefit recovery.

Provides that a person should not be disqualified from receiving the allowance where he or she is discharged from the armed forces at his or her own request. Makes new provisions for the determination of whether or not a person is actively seeking employment. Revokes a provision of the Social Security (Mariners' Benefits) Regulations 1975 relating to the payment of Establishment Benefit under the Merchant Navy Established Service Scheme which is no longer paid.

Where a disablement pension with unemployability supplement is increased in respect of a child, and the beneficiary is one of a couple, provides that the increase shall not be payable in respect of the first child if the other person's earnings are 135 pounds a week or more (versus 130 pounds previously) and in respect of a further child for each complete 17 pounds by which the earnings exceed 135 pounds.

    Amends the Jobseeker's Allowance Regulations 1996 (S.I. 1996/207), the Social Security (Back to Work Bonus) (No. 2) Regulations (S.I. 1996/2570) and the Jobseeker's Allowance (Transitional Provisions) Regulations 1996 (S.I. 1996/2567) by both correcting a number of technical errors and making certain other amendments. Makes changes in order to avoid the overlapping of benefits. Provides that an income support claimant's earnings should count towards a Back to Work bonus if they are involved in a trade dispute and become incapable of work to enter their maternity pay period. Clarifies the formula whereby days of unemployment benefit count as days of entitlement to a contribution-based jobseeker's allowance at the end of a transitionally protected period.
