Right to leave is available to employees with 26 weeks of qualifying service. Employee has option of taking either one week's leave or two consecutive weeks' leave. Leave may only be taken within 56 days of child's birth or placement with adopter. Employee is obliged to notify employer of intention to take leave and of choice in respect of available options.

Part 1 provides for statutory leave and pay. Chapter 1 of this part deals with paternity and adoption. Makes provision for paternity leave, paternity pay, adoption leave, and statutory adoption pay. Also contains provisions regarding administration and enforcement of pay. Chapter 2 of Part 1 deals with maternity. Provides for rights during and after maternity leave, maternity pay period, rate of statutory maternity pay, entitlement to statutory maternity pay, and funding of employers' liabilities regarding statutory maternity pay. Part 2 deals with tribunal reform. Part 3 provides for dispute resolution and related matters. Contains provisions regarding statutory dispute resolution procedures, contracts of employment, non-completion of statutory procedure, complaints about grievances, adjustment of time limits, and procedural fairness in unfair dismissal. Finally, Part 4 contains miscellaneous provisions.

The Working Time (Amendment) Regulations 2001 (SI 2001 No. 3256).

Regulation 13 is amended to provide that the amount of leave to which a worker is entitled in a leave year is four weeks, except in the case (provided for in paragraph (5) of the regulation) where a worker's employment begins after the start of a leave year. Spent provisions concerning the amount of leave to which a worker was entitled in leave years beginning before 23rd November 1999 are revoked. The provisions of regulation 13 limiting entitlement to annual leave to workers who have been continuously employed for thirteen weeks are also revoked. References to regulation 13 elsewhere in the Regulations are modified to take account of the fact that both paragraph (1) and paragraph (5) will apply in some cases.
A new regulation 15A is inserted, limiting the extent to which a worker is able to exercise his entitlement to leave during the course of his first year of employment. The amount of leave a worker may take at any time is limited to the amount that he has "accrued" at that time; accrual is at the rate of one-twelfth of the annual entitlement at the beginning of each month.

It amends the law relating to the arrangements under which employers are reimbursed for the statutory sick pay which they pay to their employees. Article 3(1) reduces from 100 per cent to 80 percent the amounts of statutory sick pay which employers can recover from their remittances of national insurance contributions and Article 4 provides for relief for small employers.

Insolvency Act 1986 (Chapter 45) Adoption: 1986-07-25 | GBR-1986-L-2357 Consolidates the enactments relating to insolvency and winding up of companies (including those that are not insolvent, and unregistered companies) and insolvency and bankruptcy of individuals. It contains provisions regarding, inter alia, the power to make over assets to employees and preferential debts. Schedule 6 appended to the Act lists the categories of preferential debts. Social security contributions are category 3; contributions to occupational pension schemes make up category 4; and remuneration, etc., of employees constitutes category 5. The Schedule sections entitled "Interpretation for category 5" specify that remuneration includes: a guarantee payment under section 12(1) and the Employment Protection (Consolidation) Act 1978; payments for time off for trade union duties, ante-natal care or looking for work under that Act; redundancy compensation awarded under section 101 of the Employment Protection Act 1975; remuneration payable to a person on sick leave or holiday leave; and accrued holiday remuneration.
