Trade Union Reform and Employment Rights Act 1993 (Chapter 19) Adoption: 1993-07-01 | GBR-1993-L-33848 Comprised of 4 Parts, 51 sections and 10 Schedules. Part I concerns union elections and ballots, financial affairs, membership rights, and industrial action. Part II deals with employment rights, and Part III covers other employment matters such as the constitution and jurisdiction of tribunals. In particular, the Act requires all ballots concerning industrial action to be conducted by post, and companies to obtain written consent from employees for deductions of union dues. Such consent must be renewed every three years or more frequently. Other amendments abolish wage councils which previously had set minimum pay rates for employees in specific sectors, and provide that compensation be granted by industrial tribunals to persons dismissed for asserting statutory employment rights, for carrying out health and safety duties, or for quitting their posts because of imminent danger. In addition, all employees must now receive written particulars of the main terms and conditions of their employment, and most employees shall be entitled to written pay statements.

It provides for the appointment of a Commissioner for the Rights of Trade Union Members (sections 19-21 and Schedules 1 and 2). Part II (Employment and Training) changes the name of the Manpower Services Commission to the Training Commission and stipulates its functions. Arrangements may be made to assist persons to select, train for, obtain and retain employment, or to assist persons to obtain suitable employment; allowances may be provided to persons under 18 years of age under stated conditions (section 25). Part III (Miscellaneous and Supplemental) contains definitions and Schedules 2 and 3 set forth amendments to, inter alia: Employment and Training Act (LS 1973 - UK 3A), Trade Union and Labour Relations Act (LS 1974 - UK 1), Employment Act (see LS 1984 - UK 1B), Trade Union Act (LS 1984 - UK 2) and the Employment Protection Act (see LS 1984 - UK 1A).

Dockyard Services Act 1986 (Chapter 52) Adoption: 1986-07-25 | GBR-1986-L-2486 Governs any arrangements that may be made for the provision by contractors of certain dockyard services. It declares the Transfer of Undertakings (Protection of Employment Regulations 1981) applicable to dockyard undertakings, subject to special conditions (section 1(4)). Under the Act, representatives of independent recognised trade unions shall be informed of the transfer, its legal, economic and social implications for the employees, and any measures envisaged to be taken on their behalf by the employer and/or the Secretary of State. If the Secretary envisages taking measures, consultations with trade union representatives shall take place (section 1(8)). The trade union may bring court action alleging the Secretary's failure to fulfil his duty in this regard (section 2). Other miscellaneous provisions.
