    A parent is entitled to leave for one child at a time if the child is under 2 years of age and does not have public day care during the period of parental leave. If the child is between 3 to 8 years of age, the child is entitled to half days in public day care. A prerequisite for parental leave is an agreement between the employer and the worker. Full-time or part-time leave may be taken.

    Under the Act, as last amended by Act No. 942 of 23 Dec. 1986, the woman has the right to take leave four weeks before the planned delivery. After the birth the parents have 24 weeks of leave which they may share in the following way: the first 14 weeks after the birth shall be used by the mother; however, the two weeks immediately after the birth or after the child comes home can be used by both parents. The father has the right to take leave for a maximum of 10 weeks. An employee cannot be dismissed for requesting parental leave. The same rules apply in relation to adoptive children.

    The employer can be exempted from paying all or part of the cash benefit when the employee has broken the contract of employment, has been dismissed under a contract providing for a probation period of less than three months and which dismissal has not been caused by sickness, or when the business has been closed down because of bankruptcy, death of the employer, etc. Repeals the Notification No. 319 of 26 June 1975 on the same topic.

    The employer has no obligation to pay cash benefit for the first five weeks for a newly employed person who becomes sick during the first 21 days of the employment. This does not apply to occasional employment or employment of a person who during the previous three months has been employed by the same employer.
