Measures for Implementation of the Law of the People's Republic of China on Maternal and Infant Care (Promulgated by Decree No.308 of the State Council of the People's Republic of China). - Adoption: 2001-06-20 | CHN-2001-R-76105 Implements the Law on Maternal and Infant Health Care. In particular, provides that in workplaces where a female employee with an infant under the age of one year old is employed, the employer is to allocate a certain period of time during work time for her to breastfeed the infant (Article 30).

Employment (Amendment) Ordinance 1997 (No. 73 of 1997). Adoption: 1997-06-26 | CHN-1997-L-47378 Removes and replaces provisions providing maternity leave. Maternity leave shall be a period of 10 weeks, with a further 4 weeks in case of illness or disability due to confinement. Female employees are required to give notice of pregnancy. A female employee may not be dismissed during pregnancy and during maternity leave, and shall not be required to do heavy or dangerous work if a medical certificate testifies to her unfitness to perform such work.

Employment (Amendment) Ordinance 1995 (No. 5 of 1995) Adoption: 1995-01-20 | CHN-1995-L-39754 Amends the Employment Ordinance (Cap. 57), inter alia, by adding "immediately before the expected date of her commencement of maternity leave" after "26 weeks" to section 12(1), by adding "immediately" after "40 weeks" in section 14(2)(a), and by amending the provisions relating to amount of severance payment and amount of long service payment. Adds a seventh Schedule listing maximum amounts payable and calculation of relevant years of service.

Circular of the Ministry of Labour on Issuing the Measures (for Trial Implementation) for Child-bearing Insurance of the Staff and Workers in Enterprises (LMI No. 504 of 1994). Adoption: 1994-12-14 | Date of entry into force: 1995-01-01 | CHN-1994-M-44578 Requires enterprises to establish a child-bearing insurance fund for female staff, to be paid by the employer at a rate not in excess of one per cent of the overall payroll. This fund shall cover maternity leave and expenses related to childbirth.

Law on Maternal and Infant Health Care (PRC Presidential Order No. 33 of 1994). - Adoption: 1994-10-27 | CHN-1994-L-38702 Formulated to guarantee the health of mothers and infants and to improve the quality of births. Provides that medical and health care organizations should offer premarital care services to citizens (a premarital medical checkup should include examinations for serious hereditary diseases, contagious diseases and relevant mental disorders). When a couple registers their marriage, they should present certificates of premarital medical checkups. Contains provisions on medical and health care services relevant to child-bearing, pregnant and lying-in women during their gestation and lying-in periods. Also provisions on technical certification and administration.
