Amends provisions of the Mandatory Provident Fund Schemes Ordinance (Cap. 485) regarding, inter alia, definitions of terms, the Mandatory Provident Fund Schemes Authority, the Mandatory Provident Fund Schemes Advisory Committee, employer's duty to arrange employees to become scheme members, self-employed workers' membership, contributions, portability of benefits, administration of funds, inspection, and voluntary winding-up of an employer-sponsored scheme. Also amends provisions of the Insurance Companies Ordinance (Cap. 41), the Occupational Retirement Schemes Ordinance (Cap. 426), the Employment Ordinance (Cap. 57), and numerous related laws. Inter alia, these amendments concern the administration of occupational pension schemes, severance pay, and taxes.

Section 35(3)(b) of the Occupational Retirement Schemes Ordinance (Cap. 426) requires the designated person of an occupational retirement scheme to supply certain information concerning the assets of the scheme upon a written request of a member of the scheme provided such member can produce a resolution passed by a majority of over 50 percent of the members of the scheme in support of such request. These Rules make provisions for the passing of such resolutions.

Provisional Regulations on the implementation of the system of contracts of employment in state-run enterprises, issued by the State Council.

The 34 sections of these Regulations set forth the manner in which the system of engaging workers under contracts of employment is to be administered. This system is to be applied without exception to workers recruited for regular jobs within the labour and wage quotas set by the Government (s. 2). Workers engaged under such contracts shall enjoy the same rights as those of permanent workers already working in the enterprise in relation to employment and other matters (s. 3). The Regulations set forth the mandatory contents of a contract of employment (s. 8) and govern its amendment, substitution, termination or cancellation (Chap. III). The grounds on which a contract of employment may be terminated by the enterprise or the worker are spelled out (ss. 12-16); the trade union is to be consulted (s. 17). Chap. IV governs benefits of workers engaged under contracts of employment and Chap. VI concerns their retirement benefits. The Regulations also contain administrative provisions (Chaps. VI and VII). Entry into force 1 Oct. 1986.

The approved interim provisions are included in the Resolution as its Appendix. The purpose of these provisions is to establish a retirement system for veteran cadres in China. The preferential treatment including retirement benefits and political status is guaranteed for these so-called "cadres who leave their posts in order to rest".
