Seafarers aggrieved by the refusal of a medical practitioner to issue them a certificate may apply to the Superintendent to have their cases reviewed (s. 11). Provision is made for a Hong Kong ship to be detained if, due to the failure of any seafarer to produce a valid medical fitness certificate, it cannot sail without serious risk to the safety or health of those on board (s. 13). Gives effect in part to the Merchant Shipping (Minimum Standards) Convention 1976 (ILO convention No. 147).

    Applies to ships carrying more than 5 persons (other than fishing vessels). Part II requires employers to appoint a safety officer for the ship, who in turn may elect safety representatives. Safety officers are responsible for ensuring compliance with the provisions of the "Code of Safe Working Practices for Merchant Seamen." Part III provides for the notification of dangerous occurences and of specified accidents to persons employed or carried on board. Gives effect to the Merchant Shipping (Minimum Standards) Convention 1976 (ILO Convention No. 147).

Also requires employees to take reasonable care of their safety and that of their co-workers.

Section 5 provides for safe use of pesticides on ships.

    This Regulation made under the Merchant Shipping (Safety) Ordinance (Cap. 369) gives effect to an amendment to the International Convention for the Safety of Life at Sea, 1974 and requires every Hong Kong ship on international voyage or non-Hong Kong ships while they are within the waters of Hong Kong to be provided with a certificate issued by or on behalf of the flag state of the ship specifying the minimum level of manning considered necessary to ensure the safe and efficient operation of the ship.

    These Regulations set certain requirements for vessels of a certain size to carry charts of sufficient detail to show navigation marks, known dangers and other specified information which is appropriate for each part of the intended voyage, when going or attempting to go to sea, and for matters related thereto or connected therewith. These Regulations replace in Hong Kong the Merchant Shipping (Carriage of Nautical Publicationd) Rules 1975 of the United Kingdom.

    These Regulations give effect to the International Regulations for Preventing Collisions at Sea 1972 as amended by Resolution A464 (XII) of the Intergovernmental Maritime Consultative Organization, which are set out in the Schedule. Regulation 4 prescribes the signals of distress set out in Annex IV to the International Regulations as the signals of distress to be used by ships registered in Hong Kong. Regulation 5 requires all ships registered in Hong Kong to comply with the International Regulations. These Regulations replace the United Kingdom Merchant Shipping (Distress Signals and Prevention of Collisions) Regulations 1983 (SI 1983/708) which at present apply to Hong Kong.

    These Regulations prescribe the circumstances in which signals of distress prescribed in the Merchant Shipping (Safety) (Signals of Distress and Prevention of Collisions) Regulations 1989 (L.N.140/89) are to be used by ships and the circumstances in which they are to be revoked. The Regulations replace the Merchant Shipping (Signals of Distress) Rules 1977 (SI 1977 No. 1010) of the United Kingdom in their application to Hong Kong.

    This Order amends the Schedule to the Merchant Shipping (Safety) Ordinance so that the following United Kingdom rules shall no longer apply to Hong Kong: Merchant Shipping (Distress Signals and Prevention of Collisions) Regulations 1983; Merchant Shipping (Signals of Distress) Rules 1977; Merchant Shipping (Carriage of Nautical Publications) Rules 1975; and the Merchant Shipping (Automatic Pilot and Testing of Steering Gear) Regulations 1981. The Rules and Regulations have been replaced by Regulations made in Hong Kong.
