La citada orden modifica la cláusula núm. 3 de las "Disposiciones especiales que son aplicables cuando se hace expresa referencia en la condiciones particulares" que constan en la Póliza Uniforme de Seguro de Accidentes de Trabajo y Enfermedades Profesionales, aprobada por la ordenanza núm. 237/95/M, de 14 de agosto, y modificada por la Orden Ejecutiva núm. 32/2001. Establece que, mediante el pago de la sobretasa correspondiente, el seguro también cubrirá los accidentes que puedan sufrir los trabajadores en el trayecto normal hacia lugar de trabajo o al regresar de este.

La mentada ley modifica el régimen aplicable a la reparación de los daños derivados de accidentes de trabajo y enfermedades profesionales. En tal sentido, enmienda el Decreto-Ley núm. 40/95/M, de 14 de agosto, modificado por las leyes núm. 12/2001 y 6/2007, redefiniendo los conceptos de accidente de trabajo y fuerza mayor y señalando la forma y plazos en que deberá comunicarse el acaecimiento del accidente a la Dirección de Servicios de Relaciones Laborales, así como el plazo para el pago de las prestaciones. También modifica lo atinente al régimen de infracciones y fiscalización. Por otra parte, establece la responsabilidad de las personas jurídicas por las infracciones previstas en la ley.

Provides that when an employee of an entity which has no business license, or has not been registered or filed in accordance with the law, or whose business license has been revoked in accordance with the law, or whose registration or filing has been cancelled, is injured or dies in an accident or contracts an occupational disease, or a child laborer who is disabled or deceased because of being employed by such an entity, the entity has to pay compensation in a lump sum to the disabled employee or their close relatives. Sets out the standards for such lump sum payment which depends on the extent of the injury.

La finalidad de tales ayudas e incentivos consiste en la integración laboral de los desempleados de difícil colocación en el mercado de trabajo, la contratación de jóvenes en busca del primer empleo, la inserción sociolaboral de desempleados con deficiencia física o comportamental y la formación de desempleados con vistas a su reintegración en el mercado laboral.

Este decreto-ley, de orden público, establece un régimen general de indemnización de los accidentes del trabajo y las enfermedades profesionales para el territorio de Macao. Aplícase a todos los sectores de actividad, exceptuada la administración pública. Los accidentes del trabajo causan derecho a indemnización, en forma de prestaciones en especie o en metálico. Las prestaciones en especie comprenden la asistencia médica y farmacéutica, el tratamiento hospitalario, los aparatos de prótesis y la reeducación funcional (arts. 15-33). Las prestaciones en metálico comprenden, según los casos, el pago de un capital, cuya cuantía oscila entre 36 y 96 veces el salario de base mensual (arts. 34-43). Las enfermedades profesionales, cuya lista figura en apéndice (cuadro 2), causan derecho a análogas modalidades de indemnización (arts. 44-45). Con el fin de cubrir los riesgos pecuniarios, todo empleador queda obligado a asegurarse con compañías reconocidas (arts. 54-58). Institúyese un Fondo de garantía para hacer frente en particular a situaciones de insolvencia de los empleadores o aseguradores (arts. 54-63). El decreto-ley sanciona las infracciones con penas de multa, sin perjuicio de las responsabilidades civil y penal de los infractores. El decreto-ley desarrolla el decreto-ley núm. 101/84/M sobre las relaciones de trabajo. Sus autores se inspiraron en la legislación correspondiente de Hong-Kong y en la experiencia portuguesa en este terreno.
