The Regulations cover the scope of application for consideration, jurisdiction over reconsideration, reconsideration agencies, participants in reconsideration, petitions and acceptance, hearings and decisions, time limit and service of decisions, and legal responsabilities. They were promulgated by Decree No. 70, dated 1990/12/24 (published in FBIS-CHI-90-250 of 1990/12/28).

    La acción social tiene por objeto proteger a las personas individuales y a los grupos sociales en situación de carencia mediante la concesión de prestaciones, tanto pecuniarias como en especie, y de auxilio social en equipos y servicios. Para ese fin se crea el Instituto de Acción Social de Macao (art. 15), que tiene en particular el cometido de adoptar y promover medidas de prevención, minimización y compensación de las carencias sociales y económicas de las personas y sus familiares; proteger a quienes estén en situación de carencia económica, a saber, a quienes no poseen medios de subsistencia suficientes y no puedan obtenerlos por razón de enfermedad, minusvalidez, desempleo involuntario, invalidez o vejez; colaborar a la rehabilitación y formación profesional de los inválidos y minusválidos; promover acciones de formación en servicio. El decreto-ley deroga diversos textos legislativos, en particular el decreto-ley 95/84/M, de 25 agosto 1984 y la resolución ministerial 149/80/M, de 30 agosto 1980.

    Provisional Regulations on the implementation of the system of contracts of employment in state-run enterprises, issued by the State Council.

    The 34 sections of these Regulations set forth the manner in which the system of engaging workers under contracts of employment is to be administered. This system is to be applied without exception to workers recruited for regular jobs within the labour and wage quotas set by the Government (s. 2). Workers engaged under such contracts shall enjoy the same rights as those of permanent workers already working in the enterprise in relation to employment and other matters (s. 3). The Regulations set forth the mandatory contents of a contract of employment (s. 8) and govern its amendment, substitution, termination or cancellation (Chap. III). The grounds on which a contract of employment may be terminated by the enterprise or the worker are spelled out (ss. 12-16); the trade union is to be consulted (s. 17). Chap. IV governs benefits of workers engaged under contracts of employment and Chap. VI concerns their retirement benefits. The Regulations also contain administrative provisions (Chaps. VI and VII). Entry into force 1 Oct. 1986.

    Provisional Regulations on unemployment insurance for workers and employees in state-run enterprises, issued by the State Council.

    Under these Regulations, an Unemployment Insurance Fund is set up, in part to ensure that the basic daily needs of workers and employees in state-run enterprises are met. The Regulations apply to workers and employees of bankrupt enterprises, those laid off or made redundant by an enterprise on the verge of bankruptcy or undergoing reorganisation during the period fixed by law, those whose contracts of employment have been terminated or cancelled by the enterprise and those who have been dismissed (s. 2). The Regulations provide for contributions to the Fund by workers and enterprises, and set forth the purposes for which payments may be made from the Fund (e.g. unemployment relief and medical care expenses, training or removal expenses). Employment services attached to the local labour administrative authorities are in charge of the Fund as well as of providing employment guidance and job referrals for the unemployed (s. 12). Entry into force 1 Oct. 1986.

    Este decreto-ley, de orden público, establece un régimen general de indemnización de los accidentes del trabajo y las enfermedades profesionales para el territorio de Macao. Aplícase a todos los sectores de actividad, exceptuada la administración pública. Los accidentes del trabajo causan derecho a indemnización, en forma de prestaciones en especie o en metálico. Las prestaciones en especie comprenden la asistencia médica y farmacéutica, el tratamiento hospitalario, los aparatos de prótesis y la reeducación funcional (arts. 15-33). Las prestaciones en metálico comprenden, según los casos, el pago de un capital, cuya cuantía oscila entre 36 y 96 veces el salario de base mensual (arts. 34-43). Las enfermedades profesionales, cuya lista figura en apéndice (cuadro 2), causan derecho a análogas modalidades de indemnización (arts. 44-45). Con el fin de cubrir los riesgos pecuniarios, todo empleador queda obligado a asegurarse con compañías reconocidas (arts. 54-58). Institúyese un Fondo de garantía para hacer frente en particular a situaciones de insolvencia de los empleadores o aseguradores (arts. 54-63). El decreto-ley sanciona las infracciones con penas de multa, sin perjuicio de las responsabilidades civil y penal de los infractores. El decreto-ley desarrolla el decreto-ley núm. 101/84/M sobre las relaciones de trabajo. Sus autores se inspiraron en la legislación correspondiente de Hong-Kong y en la experiencia portuguesa en este terreno.

    These Regulations are formulated to protect workers' health and to alleviate difficulties in their livelihood (Ch. 1). Ch. II covers funding and management for labour insurance. Ch. III deals with the various labour insurance benefits. Ch. IV provides preferential benefits for "model workers' and "combat heroes". Ch. V governs allocation of labour insurance funds. Ch. VI stipulates administration and supervision of labour insurance. These Regulations as a whole are still in effect, but some provisions are replaced by late practices, such as provisions regarding financing of labour insurance funds, provisions about medicare benefits and provisions concerning retirement and disability benefits.

    Chapter I - General Rules provides that the provisions apply to all the workers and staff members (including apprentices) working in each enterprise which practises labour insurance, making no distinction between nationalities, ages, sexes and citizenship, but those who are deprived of political rights are to be excluded (art. 2). Casual labourers, seasonal workers and personnel on probation shall be regulated separately (art. 5).
