    The object of this Regulation made under the Factories and Industrial Undertakings Ordinance (Cap. 59) is to protect the hearing of employees who are exposed or likely to be exposed to hazardous noise levels while at work in an industrial undertaking by requiring that a competent person make a noise assessment to identify employees who are likely to be exposed to hazardous noise levels; employees are provided with suitable approved ear protectors; exposure of employees to noise is reduced to a safe level; and adequate information, instruction and training on ear protection is provided to each employee. This Regulation also repeals the current more limited provisions respecting sound protection in the Factories and Industrial Undertakings Regulations (Cap. 59 sub. leg.).

Ch.IV lays down rules for disposal of mercurial gas, sewage and residues. Ch.V deals with occupational health service for staff and workers. Penalties are provided for in Ch.VI for violation of these Regulations.

    Este decreto-ley, de orden público, establece un régimen general de indemnización de los accidentes del trabajo y las enfermedades profesionales para el territorio de Macao. Aplícase a todos los sectores de actividad, exceptuada la administración pública. Los accidentes del trabajo causan derecho a indemnización, en forma de prestaciones en especie o en metálico. Las prestaciones en especie comprenden la asistencia médica y farmacéutica, el tratamiento hospitalario, los aparatos de prótesis y la reeducación funcional (arts. 15-33). Las prestaciones en metálico comprenden, según los casos, el pago de un capital, cuya cuantía oscila entre 36 y 96 veces el salario de base mensual (arts. 34-43). Las enfermedades profesionales, cuya lista figura en apéndice (cuadro 2), causan derecho a análogas modalidades de indemnización (arts. 44-45). Con el fin de cubrir los riesgos pecuniarios, todo empleador queda obligado a asegurarse con compañías reconocidas (arts. 54-58). Institúyese un Fondo de garantía para hacer frente en particular a situaciones de insolvencia de los empleadores o aseguradores (arts. 54-63). El decreto-ley sanciona las infracciones con penas de multa, sin perjuicio de las responsabilidades civil y penal de los infractores. El decreto-ley desarrolla el decreto-ley núm. 101/84/M sobre las relaciones de trabajo. Sus autores se inspiraron en la legislación correspondiente de Hong-Kong y en la experiencia portuguesa en este terreno.

Requires the person having the management of a "notifiable workplace" (as defined in the Ordinance) to notify the Commissioner for Labour of particulars of the operations to be carried on at the workplace; empowers the Commissioner to prohibit operations in a workplace not considered suitable in respect of the safety, health and welfare of the employees; and prescribes penalties for contraventions.
