    El citado reglamento modifica el Reglamento Administrativo núm. 6/2008, sobre medidas provisionales de subsidio complementario al salario. En tal sentido, prorroga hasta el 31 de diciembre de 2017 el plazo de aplicación de las medidas adoptadas por el decreto enmendado, fija en 40 años la edad minima para acceder al subsidio e incluye entre sus beneficiarios a los portadores de la tarjeta de registro de evaluación de discapacidad.

Determina, en tales casos, el pago de una remuneración suplementaria equivalente al 80% de la tabla de referencia prevista para los trabajadores de la Administración Pública.

    Amends the definition relating to severance payment and provides that where an applicant is entitled to a payment under a retirement scheme under his contract of employment with his employer, and an ex gratia payment in respect of a severance payment is made to him under section 16, all his rights and remedies to the retirement scheme payment shall, to the extent of the amount of the ex gratia payment made under section 16, be transferred to and vest in the Board for the benefit of the Fund and the Board may take such steps as it considers necessary to enforce those rights and remedies.

    The Ministry of Labour and Personnel issued these provisions in implementation of the Provisions of the State Council regarding the Encouragement of Foreign Investment (published in Beijing Review, No. 43, 1986). The new provisions are designed to guarantee the autonomy of enterprises with foreign investment in the hiring of personnel and in the determination of wages, insurance and welfare expenses for staff and workers. Such enterprises may determine their own organisational structure and personnel system and may engage in their own recruitment, which may, with the consent of the Department of Labour and Personnel, extend to outside the locality concerned. Personnel found not to be qualified for their posts, who have become redundant as a result of production changes or who have caused harm by having violated the rules and regulations of the enterprise may be dismissed. Wages in such enterprises are to be determined by the board of directors, but shall be no less than 120 per cent of the average wages in state-owned enterprises under similar conditions in the same trade and in the same locality. Wages may be adjusted according to the economic performance of the enterprise. The enterprise shall contribute to the retirement and unemployment insurance funds and shall pay housing subsidies. Insurance and welfare available to the workers are to be determined in line with relevant provisions issued by the Government.

    The Ordinance supplements the Employment Ordinance 1968 with a new Part VB and two schedules, providing for long service payments on separation. The amount of the payment depends on the worker's age and length of service. For example, an employee over 40 years of age who has been employed on a continuous basis for five to ten years will be entitled to compensation equivalent to two-thirds of his or her last monthly wage; such compensation will be payable only to persons who are not otherwise eligible for severance pay. The Ordinance of 1968 was published in the Legislative Series (LS 1968 - H.K. 1, 1970 - H.K. 1).
