    Regulates the establishment and adjustment of labour relationships between foreign investment enterprises and their employees (Chapter 2), labour remuneration (Chapter 3), social insurance (Chapter 4), labour safety and occupational hygiene (Chapter 5), and legal liability (Chapter 6).

    Governs the offer and conclusion of contracts, including sales and purchase contracts, gift contracts, loan contracts, lease contracts, lease-finance contracts, technology contracts, construction contracts, and work contracts. S. 4 provides that parties have the right to voluntarily form a contract in accordance with the law, and no entity or individual may interfere with such a right. Provides for the suspension or termination of contract in cases where one party acts in bad faith or becomes unable to meet the obligations of the contract. Part 7 deals exclusively with breach and liability for breach of contract. Work contracts, i.e. contracts for the production, processing, or repair of items by another party, are specifically covered by Part 15.

    Se aplica a las relaciones de trabajo en las industrias de fabricación de productos para la exportación. Se regulan los límites de la suspensión. Los trabajadores tendrán derecho a rescindir el contrato con justa causa si el empleador viola determinadas reglas. Durante el período de suspensión el empleador no podrá incorporar otros trabajadores para los puestos de trabajo de los empleados que se encuentren en suspensión. La violación a esta regla entraña para los trabajadores, el derecho a una compensación equivalente al salario medio de los últimos 30 días de suspensión.

    Provides for payment of compensation where an employing unit fails to pay wages, where wages are below the local standard of minimum wage, where the employing unit breaks a labour contract, where the worker becomes ill, or where the worker is unqualified for the position.

    Revises s. 2 so that the contract system applies to all permanent workers employed under the state recruitment-wage plan. Defines types of contracts and provides for a pension scheme to cover contract workers.

    Provisional Regulations on the handling of labour disputes in state enterprises [LS 1987 - China 1].

    The Regulations cover disputes in relation to the application of contracts of employment and summary dismissals, layoffs and dismissal for infractions of disciplinary rules (s. 2). If the dispute involves ten or more employees, it shall be considered to be a collective one (s. 4). An employee has recourse to arbitration and/or mediation (s. 5). Ch. 2 specifies the structure and composition of the bodies providing arbitration and mediation services. Ch. 3 lays down the procedures to follow in seeking a resolution to disputes; arbitral decisions may be appealed to the People's Court of Justice (s. 25). Ch. 4 addresses penalties and Ch. 5 contains supplementary provisions. Repealed in 1993.

    Provisional Regulations on the implementation of the system of contracts of employment in state-run enterprises, issued by the State Council.

    The 34 sections of these Regulations set forth the manner in which the system of engaging workers under contracts of employment is to be administered. This system is to be applied without exception to workers recruited for regular jobs within the labour and wage quotas set by the Government (s. 2). Workers engaged under such contracts shall enjoy the same rights as those of permanent workers already working in the enterprise in relation to employment and other matters (s. 3). The Regulations set forth the mandatory contents of a contract of employment (s. 8) and govern its amendment, substitution, termination or cancellation (Chap. III). The grounds on which a contract of employment may be terminated by the enterprise or the worker are spelled out (ss. 12-16); the trade union is to be consulted (s. 17). Chap. IV governs benefits of workers engaged under contracts of employment and Chap. VI concerns their retirement benefits. The Regulations also contain administrative provisions (Chaps. VI and VII). Entry into force 1 Oct. 1986.

    Provisional Regulations on the recruitment of workers in state-run enterprises, issued by the State Council.

    These Regulations provide that recruitment of workers by enterprises are to be done in public and open to all. Vacancy notices and lists of candidates having passed the required examination are to be published (s. 5). The basic conditions for recruitment are set forth: 16 years of age, in good health, educational level of junior middle school or above, good character, and passing a comprehensive examination (political integrity, knowledge, etc.; ss. 6-7). Women workers shall be recruited "for jobs suitable for women" (s. 8). The Regulations also describe the administrative arrangements for handling recruitment activities (Chap. III). The system of contracts of employment is to apply to recruitment (s. 3). Entry into force 1 Oct. 1986.

    Contracts for Overseas Employment (Amendment) Ordinance 1985.

    An Ordinance to amend the Contracts for Overseas Employment Ordinance. No. 48 of 1985. Amends the principal Ordinance in a number of respects; prescribes the minimum age of capacity for persons to whom the Ordinance applies to enter into contract of employment outside Hong Kong; enacts further provisions concerning migration from Hong Kong to the United Kingdom for employment purposes; and prescribes penalties for contraventions.

    An Ordinance to amend the Employment Ordinance [Ch. 57/1]. No. 5. Amends long title and ss. 2 and 5 and Schedule, inserts new ss. 2A (continuous contratc) and 35A (contracting out) and a new Part III (maternity protection) and repeals s. 11.

    Rules governing Employment and Dismissal of Workers by Factories and Mines promulgated on Dec. 30, 1960

    The binding forces of written contract of employment is stressed by the Rules. It also provides for payment in the event of dismissal of a worker.

    Rules governing Employment and Dismissal of Workers by Factories and Mines.

    Mines and factories shall provide employees with either fixed-term or non-fixed-term employment contracts. Probation period shall not exceed 40 days. In the event of a dismissal of a worker, severance shall be provided at a specified rate.
