    Based on Article 10 (Competencies of the agencies of interior affairs in the sphere of forced migration) of Law "On Providing to Foreign Citizens and Persons without Citizenship of Refugee Status, Additional Protection, Asylum and Temporary Protection in the Republic of Belarus", the Ministry of Interior Affairs approves the attached "Instruction on the procedure of organization of work on the registration of foreign citizens and persons without citizenship, who have arrived in great numbers at the same time to the border and the territory of the Republic of Belarus and have expressed a desire to apply for granting the status of a refugee, additional protection or an asylum in the Republic of Belarus, also the registration of foreign citizens and persons without citizenship, who have been granted temporary protection in Belarus, for the conduct of mandatory state fingerprint registration, mandatory medical examination and identification of persons of foreign citizens and persons without citizenship, who have been granted temporary protection in Belarus".

    Order No. 6 to approve the regulation on the issuance to economic entities of permits (licences) for job placement abroad of Belarussian citizens.

    In order to obtain the permit (licence) the enterprise shall submit documents to the relevant Migration Department. The decision shall be taken within 30 days. Appeal against a refusal or a cancellation of the license is possible. The license is issued for 5 years and is renewable. The licensee is not entitled to receive money in advance from potential employers or to provide to those employers the rules in force on emigration and immigration in Belarus. He must register candidates for emigration free of charge, inform them about working conditions abroad and establish their labour contracts.Appendix: application form to obtain the licence.

    "Given the employment market situation inside the country" the issuance of licences for employment of foreign manpower should be linked to emigration of Belarussian citizens for employment purposes. Foreign workers can only be employed for one year (renewable) by the employer to whom the licence was granted. The appended regulations which apply to both emigrants and immigrants provide for equal treatment. Details the content of employment contracts. The attached regulations also deal with working conditions.

    This Department is in charge of the elaboration and the implementation of the national migration policy. Its main tasks are to conclude international agreements, to regulate migration flow and use of foreign manpower, to draft legislation, etc. It is under the authority of the State Committee for Labour and Social Protection and has an autonomous budget.

    Exit from the territory can be forbidden when a lawsuit has been brought against the person who intends to leave. Provides for cases in which entry in Belarus can be refused. Foreigners have the same social and economic rights as nationals, if they are permanent residents. If neither forbidden nor reserved to nationals, any activity can be undertaken by foreigners if it corresponds to the purpose of their stay. Unless otherwise prescribed, migrant workers can join any union under the conditions generally set. Available in English.
