This Act contains rules for the public management and disposal of solid waste as defined in section 2 and including hazardous waste as defined in Schedule 1 to this Act, and provides for appointment, functions, etc. of the National Solid Waste Management Authority.
The Act consists of 49 sections divided into 7 Parts: Preliminary (I); The National Solid Waste Management Authority (II); Waste management planning (III); Environmental impact assessment (IV); Waste management licences and permits (V); Waste management operations (VI); Financing and cost recovery (VI); Miscellaneous (VII).
The Central Water and Sewerage Authority is appointed as National Solid Waste Management Authority under section 3. Functions of this Authority are set out in Schedule 3. All solid waste management facilities including land on which they are situated shall be vested in the Authority. The Authority shall draft an inventory of solid waste generated in Saint Vincent and draft a solid waste management strategy and implementation programme in accordance with indications et out in section 6 (sect. 5). An environmental impact assessment shall be carried out in accordance with sections 13 to 18 before establishment of a solid waste management facility. Section 19 of Part V prohibits the deposit of solid waste on indicated lands and waters and requires a licence to be obtained for the construction and operation of any waste management facility. A licence shall also be required for existing facilities pursuant to section 20. Section 31 defines the liability of holders of licences in case of accidents causing damage to health or the environment due to failure of the licence holder. Provisions of part VI regulate the importation, processing and other handling of waste. Only waste listed in section 33 may be imported into Saint Vincent.
