Second Region

The obligation to terminate employment contracts of employees working under private law, according to Law 2112, shall apply henceforth to all categories of workers, technicians and servants (article 1) and shall concern only employment contracts and not work contracts (article 2). Accordingly, a termination of an employment contract shall be valid only if it is notified by the employer to the employee at least five (5) days before it is effectuated (article 3). Any employer who fails to fulfil the aforementioned obligation shall pay to the dismissed employee as compensation an amount equal to the total of the regular salary or wages in general, which s/he would receive for employment during the working days, prior to which the termination should have been notified (article 5).
