During her maternity leave, an employee shall be entitled to remuneration at the weekly rate of injury benefit (excluding dependants allowance). Maternity leave is set at fourteen weeks. S. 5(3) provides that if an employee is dismissed during maternity leave, the period of maternity leave ends at the time of her dismissal. Employees are not permitted to work for a period of two weeks after childbirth (s. 5(4)). S. 11 provides that an employee who has been in regular service to an employer for 1 year at the beginning of the eleventh week before expected childbirth has the right to return to work. In special cases of redundancy, alternative work at equal terms may be offered by the employer (s. 13). Also sets forth provisions relating to complaints to the Industrial Tribunal on matters relating to maternity leave. Finally, amends the Employment and Training Ordinance to provide regulations concerning dismissals during maternity leave. Implements Council Directives 89/391/EEC and 92/85/EEC.
