Abstract/Citation
Act providing parents with a maternity leave for six months. If the leave is taken by both parents, it shall still not exceed a total of six months in whole. The woman can begin the leave one month before the estimated day of childbirth according to a medical testimonial. If the child is born sooner, the beginning of the leave is from that day. If the mother wishes to begin working before the end of the leave, she shall give the employer 21 days notice. If the father wishes to take part of the leave, he shall give the employer 21 days notice and include the duration of the leave. Adoptive parents and foster parents are entitled to the same period of leave if the child is under five years of age. If conditions at work endanger the health of the woman and the unborn child, she shall be transferred if possible. The transfer shall be on the condition that the work is the same and it shall not in any way influence the terms of wages. A pregnant woman or a parent on leave cannot be dismissed unless for valid reasons. In case of infringement the employer shall pay compensation. Parties are free to negotiate otherwise as long as the rights according to this Act are not infringed. Benefits are paid according to the Act on Social Security.
