Abstract/Citation
Makes provisions for HIV and AIDS in the workplace and transfers the review powers from the Labour Appeal Court to the Labour Court.
Inserts a new part XX A on "HIV and AIDS and Employment", which makes provision for information and education of employees, confidentiality, non-discrimination, eligibility for employee benefits, risk assessment, and workplace HIV and AIDS policy. Also deals with testing, termination of employment, protection against victimisation, care and support to employees.
Amends section 38A(b) (Jurisdiction of the Labour Appeal Court), section 226(2)(c) (Disputes of right) and section 228F (Review of arbitration awards).
