Abstract/Citation
The objective of the present Presidential Decree is to adapt Greek legislation to the provisions of Directive 99/70/EC, in order to avoid possible abuse caused by the use of successive fixed term employment contracts or employment relationships (article 1). This Decree is applicable to employees working on the basis of a fixed-term contract or employment relationship at the private sector (article 2).
In respect of employment conditions, fixed-term workers shall not be treated in a less favourable manner than comparable permanent workers, solely because they have a fixed term contract or relation (article 4).
The renewal of fixed-term employment contracts without limitation is permissible, if it is justified by objective reasons, such as the temporary accumulation of work and the performance of a temporary nature employment. In the event that the total duration of the successive contracts or employment relations exceeds two (2) years, it shall be presumed that they are used as a means of meeting fixed and constant needs of the undertaking or exploitation, resulting to their transformation to permanent employment contracts or relations (article 5).
Employers shall inform fixed-term workers about vacancies which become available in the undertaking or establishment to ensure that they have the same opportunity to secure permanent positions as other workers (article 6).
