Abstract/Citation: | This is the first labour act adopted by the People's Republic of China. Previously labour matters had been addressed solely by regulations. Comprised of 13 Chapters and 107 sections. Chapter I contains general provisions concerning applicability, rights and obligations of workers, and the right to freedom of association. Chapter II relates to promotion of employment (this includes prohibition of discrimination based on nationality, race, sex or religious belief and equal opportunities for men and women). Chapter III deals with employment contracts and collective agreements. Chapters IV and V regulate hours of work, rest and leave and wages. Chapter VI contains provisions relating to occupational safety and health. Chapter VII provides for special protection for female staff and workers and young workers. Chapter VIII deals with vocational training. Chapter IX governs social insurance and welfare. Chapters X and XI regulate labour disputes and supervisions and inspection. Chapter XII concerns legal responsibilities in the event of contravention of the Act. Chapter XIII contains supplementary provisions concerning measures of implementation and entry into force. |
