Second Region

Comprised of 12 Parts, 193 sections and 9 Schedules. Part I concerns categories of pension schemes. Parts II and III regulate the Occupational Pension Schemes Board, registration and certification of pension schemes and effects of members' state scheme rights and duties. Part IV deals with protection for early leavers. Part V regulates annual increases of pensions in payment. Parts VI, VII and VIII provide for requirements for the protection of scheme members, insolvency of employers and relationship between requirements and scheme rules. Part IX concerns modification and winding up of schemes and Part X covers investigations and the Pensions Ombudsman. The Pensions Ombudsman has the power to investigate and determine any complaint made to him by or on behalf of an authorised complainant who alleges that he has sustained injustice in consequence of maladministration in connection with any act or omission of the trustees or managers of an occupational pension scheme. The Pensions Ombudsman may also investigate and determine any dispute of fact or law which arises in relation to such a scheme between the trustees or managers of the scheme and an authorised complainant.
