Tripartite Consultation Workshop on the Reform of the Law on Contract-Based Vietnamese Overseas Workers (Law 72)

The workshop aims to assist in framing policies and adjustments to be made to the Law 72 through enable key stakeholders to provide their views on the review and revision of the law conducted by DOLAB and for the consultant to present preliminary findings of the independent evaluation. The workshop will also allow participants to increase awareness of the international standards relating to labour migration and best practices of the other origin countries in formulating law governing labour migration.

To assist in framing policies and adjustments to be made to the Law 72, TRIANGLE in ASEAN programme will support DOLAB to organize a consultation workshop with tripartite constituents, related agencies, researchers, experts and social partners. The intention is that this workshop will enable key stakeholders to provide their views on the review and revision of the law conducted by DOLAB and for the consultant to present preliminary findings of the independent evaluation. The workshop will also allow participants to increase awareness of the international standards relating to labour migration and best practices of the other origin countries in formulating law governing labour migration.

 

The workshop will be attended by tripartite constituents (DOLAB, Viet Nam Association of Manpower Supply, Viet Nam General Confederation of Labour), related departments of MOLISA, related ministries including MOFA, MOJ, National Assembly, Government Office, Ministry of Public Security, Supreme Court, representatives from the Department of Labour, Invalids and Social Affairs in each of the five target provinces under the TRIANGLE in ASEAN programme, recruitment agencies, NGOs and international organizations.  

Expected outputs of the workshop:

Written inputs to the reports on Law review and Impact Assessment will be informed by feedback gathered at the workshop and submitted. Presentations are prepared and presented at the workshop to brief participants on preliminary findings and recommendations of study/research to facilitate discussion on the limitations of the Law 72, new policies proposed and adjustments to be made. In particular, presentations will cover the key policy objectives of the relevant law/s, how legal provisions support these objectives, and the implementation and demonstrated effectiveness of the law/s. A key focus of the presentations will be how the law has/has not increased protections for migrant workers and promoted fair and ethical recruitment practices. Presentations will also cover the process undertaken to develop, or reform, migration law to assist stakeholders in considering the next steps for Viet Nam’s law review and revision.

Workshop minutes will be made ready by DOLAB after the workshop in which feedbacks and recommendations from participants for the law review, new policies, impact assessment, outline of the revise law and next steps highlighted.
