Development of the Amendment and Supplement to the Decree on Administrative sanctions for social protection and relief, and protection and care of children

From July 2017 to June 2018, ENHANCE project will work with MOLISA Legal Department to develop the amendment and supplement to the Decree on Administrative sanctions for social protection and relief, and protection and care of children.

A committee for drafting of the Decree on amendment and supplement to the Decree No. 144/2013/NĐ-CP has been established by MOLISA, and chaired over by a MOLISA’s leader. An Editor Board also has been established which comprises of around 27 experts from different ministries and led by the MOLISA Department of Legal Affairs, to help the Drafting Committee to draft the Decree on amendment and supplement to the Decree No. 144/2013/NĐ-CP.

In parallel with the drafting the Decree, a Policy Impact Assessment will be conducted to assess and inform the Drafting Committee of the potential impacts of the amended Decree on the country social and economic development, administrative procedures, gender equality, as well as impact on the general legislative system. The Impact Assessment will be done in coordination with affected departments and consultations of affected stakeholders and the general public in order to reflect a range of considerations, thereby improving the legitimacy of policies, and to come up with an assessment report findings to be finalized and forwarded to decision makers.

Three technical consultation workshops will be organized, two in Hanoi, and one in Ho Chi Minh city, for around 180 policy makers, law enforcers and executors, labour inspectors, researchers, employers and workers, child protectors, social civil and mass organization members, health staff, and other Government concerned officers of 27 provinces and cities. The first two workshops is to present the Policy Impact Assessment, and to share the Draft of the amended and supplemented Decree in order to get the participants’ inputs, recommendations and/or reactions; and the third workshop is organized to have a final review of the draft Decree and draft-Decree-attached documents before submission to the Government.

After the Consultation Workshops, the Editor Board, will revise the draft Decree and submit the document to the Government competent authorities for appraisal and approval.
