1. We are RR&CO, Specialist Chemical Tanker Lawyers, appointed by and representing the Owners of M/T “EASTERN QUINCE”, which your ITF Inspector Mr. Ranjan (+94773147005) attended at Colombo port on 11 January 2024.
2. Such attendance confirmed the standard of living, food and salary of all Vietnamese seafarers onboard. After all documents, as attached, were submitted and confirmations signed by the crew members (as witnessed by your ITF Inspector), the Vessel was passed and allowed to sail out. Accordingly, the Abandonment ID 00873 has been closed out.
3. However, such Abandonment ID 00873 record on the ILO/IMO Database is not yet updated, see attached. Could we ask for this to be updated as soon as possible and confirmation regarding same sent to us by return email.
4. We kindly remind ILO of their obligations under Paragraph 34 of “Guidelines on how to deal with seafarer abandonment cases” (13-15 December 2022; Ref: TWGSHE/2022/7), attached, which states: “The ILO/IMO Database on reported incidents of abandonment of seafarers should be expeditiously updated, particularly when cases are resolved”. Such attendance and resolution of the case was on 11 January 2024, it is now 2 months later but the ILO/IMO Database is not yet updated. We request that it is “expeditiously updated” today.
5. We understand that the case is resolved as “the totality of all outstanding remuneration and contractual entitlements have been paid and duly received by all the crew members” as per IMO’s Seafarer Abandonment webpage at https://www.imo.org/en/ourwork/legal/pages/seafarer-abandonment.aspx (copy attached) as per the payroll payment evidence attached and as confirmed by your attending ITF Inspector.

Gouv. de Viet Nam (12 mars 2024) Regarding the abandonment case notification of the Vietnamese seafarers working on M/v EASTERN QUINCE (IMO Number: 9379040, flag: Panama), We would like to provide you some information for this matter as follows: M/v EASTERN QUINCE is owned by Vietnam shipowner: Asia Pacific Shipping Company Limited (APSC). Immediately after receiving the report form IMO, Vinamarine had contacted the shipowner to investigate and verify the case information. According to the shipowner's report: For the labor of vessel Eastern Quince, APSC always compliance with National Rules and International Regulations, the crew are paid wages properly. Until now, APSC still not yet received any complaints from the crew about labor or wages. We would like to send the Crew List and evidence of the corresponding payments (the file as attachment). Please kindly support to consider for this issue.
