Fed. int. des ouvriers du transport (ITF) (3 mai 2018) SKULD financial security paid out USD600k and Nautilus members have arrested the vessel via the Union for the further USD400k owed to them. The first court date the Maltese lawyer has is on 8 May 2018 and members are being kept up to date via internal Nautilus bulletins.There is apparently a buyer lined up for the vessel who has requested sea trials. Other arresting parties are content with arrangements for sea trials but we are likely to seek further assurances before agreeing to these taking place.
Autre (25 mai 2018) From: David Bolomini Sent: 25 May 2018 17:02 To: Jan de Boer ; RE: New Abandonment case: Super Yacht Indian Empress By way of an update on this listed case, the P&I insurance provider, Skuld, has paid outstanding wages which, after applying the MLC four month cap, amounted to USD 851,567.49. The liability for wages claimed under the MLC financial security has therefore been met in full. Skuld worked in cooperation with Nautilus who paid wages accrued in excess of the four month cap. We are not sure about the accuracy of the figure of approx. USD 350,000 outstanding as noted in the report. Although we note reference to a skeleton crew remaining on board, we understand that all crew on board at the time of abandonment have been repatriated. We are not clear about the status of the skeleton crew, but it is possible that it consists of crew members who were not onboard at the time of the abandonment. Both Skuld and Nautilus have taken legal action against the vessel to recover their outlays, as have a number of other creditors. I hope this is helpful information.
