Vessel run aground on 19 January 2022.
Temporary repairs carried out. PC issued provisional permit to sail. Rice cargo damaged and needs to settle 1m USD. Bureau of customs holds vessel. 5 months owed wages. Insufficient food provision, drinking and service fresh water and fuel. Cargo spoiled smell due to water contamination. P&I coverage terminated on 17 April 2022.

Comentarios y observaciones:Fed. Int. de los Trabajadores del Trasporte (ITF) (22 Julio 2022)
The owner has not responded to ITF communications. Flag state have already been informed of the case but no update recently.
The P&I of the vessel, have appointed lawyers to represent them on their behalf.
Indonesian Embassy have been requesting clearances for repatriation but with no success.
An online meeting is being arranged by the P&I lawyers and all stakeholders and concerned government officials.


Panamá (26 Agosto 2022)
In response to the labor complaint filed against the vessel "SKY FORTUNE", with IMO No. 9103609, you will find the latest communications:
l. Through Email dated on April 18, 2022, the PMA sent Communication addressed to Owners, Operator and/ or Local Resident Agent, communicating the labour complaint filed against the vessel, and requesting the measures taken to correct such deficiencies.
2. This Administration has imposed an administrative restriction over the vessel.
3. Through Email dated on April 19, 2022, the activation of the financial guarantee was requested.
4. Technical documents have been issued by the Flag State, to reduce the crewmembers to a minimum, which was requested by the PSC.

I am Eki Kristianto Captain of MV Sky Fortune, I want to ask about Our repatriation?
Did the clearance from immigration been approved for us? When we can go home and get our salaries?
Because we are already stressed here, We are here for 8 months without salary. Why they not paid our salaries?
Can you Sir / Madam imagine how the condition of our family we left behind for 8 months we did not provide our wives and kids, because our situation here is not paid for 8 months. My wife has to go into debt to meet daily the family needs. My son has to stop his education because there is no more money.
please Sir / Madam help us, simplify the bureaucracy don't make it difficult. so we can home soon and get our salary.

From Tokyo MOU Secretariat

Tokyo MOU Secretariat asked the port authority to take actions on 2nd September, and received the message below for the Philippine Coast Guard relating to the relevant actions by the Authority.

China (13 Septiembre 2022)
The Marine Department of Hong Kong China issued a reminder letter to the ship's operator, "Tian Ze Shipping Co Ltd", on the subject in early September 2022. Still, no feedback has been received until now.

8 Filipino crew signed off, leaving 2 Myanmar and 1 Chinese seafarer onboard. Wages for Filipinos and Burmese have been paid by their respective manning agencies. Chinese crew not paid since January.

Panamá (20 Marzo 2024)
Through email date April 18 we sent an email to the shipowner to notify him of the complaint received.
Through email date april 18, 2022 we sent an email to On 18, 2022, we sent an email to the MLC section to request the financial guarantee certificate and it in forms us that they recently expired.
Through email date April 19, 2022, the vessel was documentary restricted.
Through email date April 19, 2022, the activation of the financial guarantee was requested.
since despite the fact that it has expired at the time that the state of abandonment was reported, it was still in force.
Through email date June 10, 2022 the email to the P&I of the activation is reiterated
On June 29 we request a flag inspection.
Through email date July 08, 2022, We receive email from P&I
informing us of the following "We refer to the captioned file.
Our Philippines lawyers are trying to reach your officers to discuss on the crew repatriation matters. Please find the attached emails they sent to Manila office.
The vessel is still at the anchorage, and we wish to discuss with you on the minimum safe manning/ special approval in order to allow some of crew member to leave vessel. We understand that one of your colleagues in Manila office are considering to arrange a visit the vessel, however, we have not received a firm update/confirmation on this matter.
As the Indonesian crews are the essential crews members (including master) for the vessel, in order to allow all 6 of them to leave the vessel, the crews will need your assistance and coordination with the local port state to allow vessel to proceed to a layup berth eventually.
Please let us know if any further explanation needed and we look forward to receive a positive respond from you. Many thanks".
Through email date August 16, 2022, We sent an email to P&l
requesting information on the repatriation of the seafarer of the Sky Fortuner ship, which replied that it was necessary to authorize the minimum safe manning we spoke with the head of Segumar in the Philippines who informed us that he could occur if the vessel is in dock or anchorage.
Through email date September 2, 2022, we received an email from the captain of the Sky Fortuner vessel requesting that the date of repatriation be given to the P&I.
Through email date September 8, 2022, we request information from the P&l on the date of repatriation.
Through email date Oct. 04, 2022. On October 4, 2022, I sent an email to the P&I requesting information on the repatriation of the Sky Fortuner crew, who told us the following:
"We are happy to update that the 6 Indonesian crews have been repatriated to their home country on 29th Sep 2022. Before that, the club has paid the 4 months wages to them, witness by the officers from Indonesian Embassy, club's representative and Notary Public".
We have sent an email on March 23, 2023 to the captain requesting information about the repatriation and payment of wages owed.
We have not received an answer yet.
Through email date April 4, 2023, a message was received from the complainants informing them that they had already been repatriated and that they had received 4 of the 5 months of salary owed.
