Submission. The Committee notes the Government’s indication that, following consultations with the social partners, the necessary measures will be taken to issue a Council of Ministers’ decision regarding the Informal to the Formal Economy Recommendation, 2015 (No. 204), and the Employment and Decent Work for Peace and Resilience Recommendation, 2017 (No. 205). Moreover, on 29 June 2022, the Tripartite Committee for Labour Affairs decided that the Government should proceed with the ratification of the Violence and Harassment Convention, 2019 (No. 190). The Government further indicates that communications with the Ministry of Foreign Affairs and Expatriates Affairs and other relevant authorities concerned are envisaged to request for their opinion in accordance with the Prime Minister’s Circular No. (20/11/23/27129) of 28 October 2022 regarding procedure to be followed for, inter alia, the ratification of conventions.
In this respect, the Committee wishes to highlight once again that the completion of the submission process does not require a decision to ratify a Convention or Protocol. In its 2005 Memorandum concerning the obligation to submit Conventions and Recommendations to the competent authorities, the Committee noted that the main aim of submission is to promote measures at the domestic level for the implementation of Conventions and Recommendations, as well as to promote ratification of Conventions. Governments remain entirely free to propose and action which they may judge appropriate in respect of ILO instruments. One purpose of this obligation is that the instruments adopted by the Conference are brought to the knowledge of the public through their submission to a parliamentary body (Memorandum, Part I(a)–(c)). The Committee recalls once more that the constitutional obligation of submission is of the highest importance and is a fundamental element of the standards system of the ILO. The Committee therefore once again reiterates its request that the Government provide information on the submission to the House of Representatives (Majlis Al-Nuwaab) of the Transition from the Informal to the Formal Economy Recommendation, 2015 (No. 204), adopted at the 104th Session of the Conference, the Employment and Decent Work for Peace and Resilience Recommendation, 2017 (No. 205), adopted by the Conference at its 106th Session, and the Violence and Harassment Convention (No. 190) and Recommendation (No. 206), 2019, adopted by the Conference at its 108th Session. The Committee trusts that the Government will provide the information requested without further delay.
