Effect given to the recommendations of the committee and the Governing Body

The Committee last examined this case, which relates to the Government’s refusal to appoint the Trade Union Confederation of Workers of Mali (CSTM) to the Economic, Social and Cultural Council (CESC) and to the national tripartite consultation bodies in general, at its March 2022 meeting [see 397th Report, paras 34–36]. On that occasion, aware of the difficult situation in the country, the Committee expressed the expectation that the Government would take the necessary measures to hold a social conference with one of the objectives being to establish the modalities of professional elections for the determination of the representativeness of trade union organizations. The Committee requested the Government to keep it informed of any new developments on that issue, which has been the subject of its long-standing recommendations.
2. 33. In its communication dated 18 January 2023, the Government indicates that the social conference was held from 17 to 22 October 2022 with 139 recommendations adopted. This includes establishing a national tripartite committee of experts to develop and adopt the Social Stability and Growth Pact (hereinafter “the Pact”), with an action plan for the implementation of the above-mentioned recommendations. The organization of professional elections for the determination of the representativeness of trade union organizations is prioritized in the recommendations and a timeline will be defined in the action plan for such purposes. The Government indicates that the preparatory work will begin in 2023 upon the signing of the Pact and the action plan, scheduled for February 2023. The Government also indicates that it will seek the ILO’s guidance in this regard.
3. 34. The Committee takes due note of the information provided by the Government and welcomes the above-mentioned commitments and developments. The Committee expects that the professional elections for the determination of the representativeness of trade union organizations will be conducted without delay and requests the Government to continue to provide information on any developments on this issue, including on the timeline and modalities established for the elections. The Committee expects that the Government will benefit from the ILO’s guidance in that respect.
