  1. 107. In its previous examination of the case, in June 2012, the Committee made the following recommendations on the matters still pending [see 364th Report, para. 912]:
    • (a) The Committee firmly expects that the changes that the Government considers necessary for the concession system for “inter-union passes” in the bullfighting sector will be introduced soon and in accordance with the principles enounced in the conclusions, so that trade union organizations in the bullfighting sector, without distinction whatsoever, can issue inter-union passes.
    • (b) The Committee requests the Government to keep it informed of developments.

In its communication dated 26 October 2012, the Government states that it has proposed the establishment of an intersectoral working group on “inter-union” passes, comprising the trade unions that represent workers who are artists; related state agencies, such as the Ministry of Labour and Employment Promotion, the Social Health Insurance Institute (EsSalud), the Ombudsman’s Office, a representative of the International Labour Organization, the Office of the National Superintendent of the Tax Administration and the Ministry of Culture were also invited to participate in the working group. On 12 October 2012, a meeting was held with the unions to hear their views on the matter and it is hoped that, at the second meeting, it will be possible to reach a consensus on the issue, to determine the subjective scope of the right in question and set up a non-discriminatory mechanism regarding the legitimate right of organizations to issue the “inter-union” passes, in order to safeguard the freedom of association of these organizations.
  3. 109. The Committee duly notes this information, requests the Government to ensure that the complainant trade union (SIPAT–PERU) is included in the consultations and expects that, in the near future, a solution will be reached that is satisfactory to the parties concerned.
