Convention concerning Statistics of Wages and Hours of Work, 1938 (No. 63) - United Republic of Tanzania (Ratification: 1962)

The Committee recalls that the ILO Governing Body, at its 334th Session, (October–November 2018), on the recommendation of the Standards Review Mechanism Tripartite Working Group, confirmed the classification of the Convention concerning Statistics of Wages and Hours of Work, 1938 (No. 63) as an outdated instrument. The Governing Body therefore placed an item on the agenda of the 113th Session of the International Labour Conference (2024) for the consideration of its abrogation or withdrawal; however, the Committee notes that the postponement of the 2020 Conference due to the COVID-19 pandemic may impact on the session numbers or dates of the Conferences at which these Conventions will be considered for abrogation or withdrawal. The Governing Body requested the Office to undertake follow-up action to actively encourage the ratification of up-to-date instruments concerning labour statistics. The Committee therefore encourages the Government to follow-up the Governing Body’s decision at its 334th Session (October–November 2018) approving the recommendations of the Standards Review Mechanism Tripartite Working Group, and to consider ratifying the Labour Statistics Convention, 1985 (No. 160), as the most up-to-date instrument in this subject area.

Article 1(c) of the Convention. Communication to the ILO of the statistics covered by the Convention. The Committee notes with regretthat the Government’s report provides no concrete information in response to its previous comments initially made in 2016. It therefore recalls that, from the information available to the ILO Department of Statistics, the main sources of statistics on wages and hours of work in the United Republic of Tanzania are: the Integrated Labour Force Survey (which includes a time–use module), presenting statistics on wages and hours of work for the economy as a whole and agriculture, mining and manufacturing in particular (latest one referring to 2014); and the Employment and Earnings Survey, an annual establishment survey which provides statistics on wage rates and earnings for the economy as a whole and agriculture, mining and manufacturing in particular. Statistical and methodological information derived from these surveys is available through the National Bureau of Statistics’ website. The Government also indicated in its 2016 report that a meeting was held in February 2015 with the technical support of the ILO with a view to discussing and improving the questionnaire used to collect information for the Employment and Earnings Survey to ensure that it includes issues of working hours and wages. In addition, the Government indicated that a labour force survey was being conducted in Zanzibar that allowed for the compilation of statistics on wages, earnings and hours of work. The Committee reiterates its request that the Government provide information on any developments in the improvement of the questionnaire used for the Employment and Earnings Survey. The Government is also requested to communicate a copy of the latest labour force survey being conducted in Zanzibar when it becomes available. The Committee once again reminds the Government of the availability of ILO technical assistance.

The Committee reminds the Government of the availability of ILO technical assistance in this regards.

The Committee notes the Government’s report which was received at the ILO on 1 October 2010.

Article 1 of the Convention. Compilation, publication and communication of statistics relating to wages and hours of work. In its previous comments, the Committee had emphasized the need for the Employment and Earnings Survey (EES) to include statistics of hours of work (normal hours of work and hours actually worked) as well as statistics on wages and hours of work in Zanzibar and for the EES to be published, disseminated and communicated to the ILO as soon as practicable.

The Government’s report indicates that, due to financial constraints, it has been difficult for the National Bureau of Statistics to conduct the EES on an annual basis and include in this survey statistics relevant to working hours. The Committee also notes that even though the National Bureau of Statistics has taken measures to ensure that the Government of Zanzibar conducts its own survey consistent with the EES, it has been difficult for Zanzibar to do so due to human resource and financial constraints.

The Committee requests the Government to indicate any measures taken or envisaged, including the mobilization of resources through international cooperation, so as to ensure that the Employment and Earnings Survey is carried out on a regular basis, is published, disseminated and communicated to the ILO as soon as practicable, and includes statistics on hours of work in mainland Tanzania as well as statistics on wages and hours of work in Zanzibar.

In this regard, the Committee draws the Government’s attention to Resolution I adopted by the 18th International Conference of Labour Statisticians concerning the measurement of working time. The Committee notes the Government’s report received by the Office in November 2005, and the report analysing the Employment and Earnings Survey for 2001 (EES).

The Committee notes with interest that the EES has been revived under the responsibility of the National Bureau of Statistics, with the first survey being conducted with reference to June 2001, and the results published in 2004, based on a sample of formal sector enterprises. As the EES is conducted on an annual basis, the Committee notes that the results of the 2002 and 2003 surveys will soon be available. The statistics compiled meet most of the requirements of the Convention; however, as the results of the EES are compiled on a monthly and an annual basis, it would appear that relevant statistics on working hours (normal hours of work and hours actually worked) are not compiled. Furthermore, the Committee notes that no information is provided as to whether the Government of Zanzibar intends to conduct a similar survey. The Committee requests the Government to indicate whether measures have been adopted so that: (i) in future surveys, relevant statistics on hours of work are collected and compiled; and (ii) the survey is extended to Zanzibar. The Government is requested to ensure that the results of the EES, as of 2002, are published, disseminated and communicated to the ILO as soon as practicable.

The Committee notes the Government’s report for 2000 and Order No. 311 of 28 June 2002 issuing regulations on wages and conditions of work. It notes that the employment and earnings survey of 1990 was abandoned because it no longer reflected the reality of the situation characterized by inflation, socio-economic changes and the effects of structural adjustment programmes. The Committee notes that the integrated survey on the labour force (covering the general labour force, child labour and the informal sector in mainland Tanzania), which was conducted in early 2000 with ILO assistance and in conformity with international statistical definitions, was completed and its results communicated to the ILO in August 2003. The purpose of that survey was to obtain quantitative and qualitative reference data on certain characteristics of the labour force to enable the Government to formulate its training and employment policies and to implement the 1997 national employment policy and the 1998 Act concerning the national employment promotion service. While noting with interest that the results of the survey meet the requirements of the Convention, the Committee nevertheless notes the absence of any subsequent compilation of statistics of average wages and of hours of work. Even though the categories of workers covered by the Convention represent a very small proportion of the current labour force (7.4 per cent), the Committee hopes that the Government will adopt measures ensuring that statistics of average earnings and of hours actually worked, of time rates of wages and of normal hours of work will be compiled on a regular basis.

Tanganyika Article 1 of the Convention. The Committee notes that the Employment and Earnings Survey for 1982 and other publications which were, according to the Government's report, issued by the Bureau of Statistics, have not been received by the ILO. It hopes that copies of these publications will be communicated to the ILO in the very near future.

Part II. The Committee notes with interest from the Government's report that, with the assistance of the ILO, a unit dealing with labour statistics has been established in the Labour Division of the Ministry of Labour and Manpower Development, and that it is hoped that in the near future this unit will be in a position to collect, compile and analyse the information called for by Part II, which was excluded from acceptance when the Convention was ratified. The Committee hopes that the Government will be able to indicate in its next report that further progress has been achieved with a view to the application of this Part.

Part III. The Committee notes that the Government's report does not fully reply to the points raised in its previous comments. It hopes that the Government will supply a copy of Government Notice No. 152 of 1972 to which reference was made in the report, as well as the publications mentioned under Article 1 above. It does not appear from the information in the report, however, that the kind of statistics called for in this Part of the Convention are now available.

Zanzibar

The Committee notes with regret that the Government's report contains no information concerning the application of the Convention in Zanzibar. It once again expresses the hope that the Government will provide such information in its next report. It understands in this connection that assistance being provided is likely to result also in improvements in the collection and compilation of labour statistics in Zanzibar.
