Convention concerning Statistics of Wages and Hours of Work, 1938 (No. 63) - Algeria (Ratification: 1962)

Parts I–IV of the Convention. Statistics relating to wages and hours of work. The Committee notes the legislative texts and regulations provided by the Government with its report. The Annual Survey of Wages in Enterprises and the Household Employment Survey, both carried out by the National Statistical Office (ONS), are the principal sources of statistics of wages and hours of work. The Committee notes that the statistics of hours of work derived from the Household Employment Survey, as published on the ONS website, are not disaggregated by economic activity. The Committee also notes that the Annual Survey of Wages in Enterprises does not include statistics of wages in agriculture, as required by the provisions of Part IV. With regard to statistics relating to hours of work, the Committee requests that the Government take the necessary measures to establish more detailed statistics, as required by the Convention. The Committee also requests that the Government provide statistics of wages in agriculture.

The Committee notes the recommendations of the Standards Review Mechanism Tripartite Working Group and the corresponding decision of the Governing Body at its 328th Session in October–November 2016 (GB.328/LILS/2/1) calling upon the Office to commence follow-up with member States that are still bound by the Convention, encouraging them to ratify the Labour Statistics Convention, 1985 (No. 160), as the most up-to-date instrument in this area, and resulting in the automatic denunciation of Convention No. 63. The Committee reminds the Government of the availability of ILO technical assistance in this regards.

The Committee notes that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous comments.

The Committee notes the Government’s commitment to implement the provisions of this Convention. It notes that the latest wages surveys were carried out in 2002 by the National Labour Institute, in 2005 by the central services of the Ministry of Labour, Employment and Social Security, and in 2007 by a private studies office. The Committee requests the Government to indicate whether, in accordance with the provisions of Part II of the Convention, statistics on the average earnings by branch of economic activity have continued to be compiled and published since 2007 and, if so, the type of survey. Furthermore, it reminds the Government that these statistics and the corresponding methodological information should be sent to the ILO as soon as practicable.

The Committee notes that, according to the Government, with regard to hours of work, the collection of more specific data as defined by the ILO for the purposes of the Yearbook of Labour Statistics is not operational for the time being but it is envisaged that specific surveys relating to hours of work will be carried out. The Committee requests the Government to keep the Office informed of any developments in this regard. It draws its attention to the new international standards relating to the measurement of working time in the form of Resolution I, adopted at the 18th International Conference of Labour Statisticians which defines the more extensive concepts and measures in detail.

The Committee notes that the wage statistics available on the web site of the Algerian National Statistics Office (www.ons.dz) refer solely to overall payroll trends (and to the income of self-employed workers) between 1997 and 2001. Noting the absence of statistics on average earnings by branch of economic activity and recalling that such statistics and the corresponding methodological information should be sent to the ILO as soon as possible, the Committee would be grateful if the Government would provide information on the manner in which effect is given to the provisions of Part II of the Convention on the subject and specify, if appropriate, the type of source on the basis of which the abovementioned data are compiled and published.

The Government is also requested once again to take measures to compile and publish: (i) statistics of hours actually worked or paid in the mining, manufacturing, building and construction industries, in accordance with Part II of the Convention; and (ii) statistics of wages and hours of work in agriculture, in accordance with Article 22, and to keep the Office informed of any progress made in this regard.

Finally, referring to its general observation on the Convention, which was repeated in 2000, the Committee again invites the Government to contemplate ratifying the Labour Statistics Convention, 1985 (No. 160), and thus ipso jure denouncing the present Convention. In this respect, technical assistance from the Office may be requested in order to facilitate the process.

Article 1 of the Convention.  The Committee notes that the most recent wage statistics appear to date back to 1996. It asks the Government, in connection with this Article, whether measures are envisaged to reduce the time between the period covered by the statistics and their dissemination, and requests it to publish the data compiled in pursuance of this Convention (in the most appropriate form - publications or dissemination over the Internet) and to communicate them to the ILO as soon as possible.

Parts II and IV.  The Committee notes with interest that statistics on average earnings covering all branches of economic activity (other than agriculture) are compiled on the basis of a six-monthly sample survey of public and private economic enterprises, which has been carried out by the National Statistics Office (ONS) since December 1991. It also notes that the results of the survey were sent to the ILO for the period 1992-96 (1998 in the case of public institutions). The Committee asks the Government to indicate whether measures have been envisaged to compile and publish: (i) statistics of hours actually worked or paid in the mining and manufacturing industries, including building and construction, in accordance with Part II of the Convention; and (ii) statistics of wages and hours of work in agriculture, in accordance with Article 22.

Part III.  The Committee notes that time rates of wages and normal hours of work are fixed by decree and that recent data are available in the report.

Observation (CEACR) - adopted 1999, published 88th ILC session (2000)

The Committee notes that the Government's report has not been received. It must therefore repeat its previous observation which read as follows:

Parts II and IV of the Convention. The Committee notes that, according to the Government's report, the National Statistical Office has embarked upon the reorganization and strengthening of its structures in order to improve the collection, compilation and dissemination of statistics, particularly concerning wages and hours of work. It hopes that the statistical data obtained following these reforms will be transmitted to the Office in the near future. It also requests the Government to supply information concerning the scope of these statistical inquiries, the types of data compiled and the publications in which the data are published. Part III. The Committee notes the information supplied by the Government concerning the rate of the guaranteed national minimum wage and the level of family allowances. It once again hopes that the Government will take the necessary measures to compile, publish and transmit to the Office statistics of time rates of wages and of normal hours of work in accordance with Articles 13 to 23 of the Convention.

The Committee hopes that the Government will make every effort to take the necessary action in the very near future.

Article 10 of the Convention. The Committee notes that, according to the Government, the amount of work required to compile statistics of average wages and hours of work for juveniles, would appear to be out of proportion to the low employment rate of juveniles. The Committee hopes that the Government will reconsider its policy in this respect in the event of an increase in the employment rate of juveniles.

The Committee notes that the Government's report has not been received. It must therefore repeat its previous observation which read as follows:

Article 1(b) and (c) of the Convention. The Committee notes from the Government's report that statistics of average wages and hours of work are available for 1981, 1982, 1983 and 1984. Please indicate whether these statistics have been published. The Committee hopes that the Government will communicate the data that have been compiled to the Office at the earliest possible date, as provided for in this Article. Part II, Articles 8 and 12 and Part IV. The Committee notes that the methods employed for the "employment and wages" survey are once again being reconsidered, in view of the coming into force of the texts issued by the SGT. The Committee hopes that the Government will communicate the necessary information in this respect with its next report, and that it will indicate the impact that the new methods may have on the data that are compiled. Part III. The Committee notes that the Government decided to supplement its statistics with information concerning hours of work and wage rates as established by the regulations in force. The Committee once again expresses the hope that the Government will adopt the necessary measures in the near future to give effect to the provisions of Articles 13 to 23 of the Convention.

The Committee hopes that the Government will make every effort to take the necessary action in the very near future.
