Submission. The Committee notes the Government’s indication that, on 19 July 2023, a meeting was held with the social partners concerning the possibility of ratifying the Violence and Harassment Convention, 2019 (No. 190). The Government adds that further discussions with all federal ministries concerned were envisaged to take place in September 2023 regarding the adjustments needed at the national level that would be necessary for the ratification of Convention No. 190. Moreover, the Government reiterates that there is no agreement at the level of the social partners with respect to certain legislative amendments that would be necessary for the ratification of Convention No. 189 and that the submission of a report to the National Council of Convention No. 189 and its accompanying Recommendation No. 201 is under consideration. Lastly, the Government indicates that submission of reports concerning the Transition from the Informal to the Formal Economy Recommendation, 2015 (No. 204), and the Employment and Decent Work for Peace and Resilience Recommendation, 2017 (No. 205), to the National Council is under consideration. In this regard, the Committee wishes to highlight once again that the completion of the submission process does not require a decision to ratify a Convention or Protocol. In its 2005 Memorandum concerning the obligation to submit Conventions and Recommendations to the competent authorities, the Committee noted that the main aim of submission is to promote measures at the domestic level for the implementation of Conventions and Recommendations, as well as to promote ratification of Conventions. Governments remain entirely free to propose and action which they may judge appropriate in respect of ILO instruments. One purpose of this obligation is that the instruments adopted by the Conference are brought to the knowledge of the public through their submission to a parliamentary body (Memorandum, Part I(a)–(c)). The Committee recalls once more that the constitutional obligation of submission is of the highest importance and is a fundamental element of the standards system of the ILO. The Committee therefore reiterates its request that the Government provide information on the submission to the National Council of the six pending instruments, including specifying the dates of submissions.
