Repetition The Committee recalls that, since 2006, the Government had been reiterating that the conditions for implementing the Convention did not exist, Afghanistan being a landlocked country without any dock or industrial harbour. The Committee notes the Government’s statement that with the opening of Iran’s Port of Chah Bahar in the Sea of Oman, new perspective has emerged on the country’s access to navigable waterways. Consequently, the Government anticipates that the Convention will begin to have greater relevance, enabling it to report on effect given to its provisions. The Committee notes this statement and requests the Government to provide information on any development in this respect, including the development of industrial harbours within the country’s navigable waterways entailing the use of dock work and a national policy to provide dockworkers with regular or permanent employment.
Repetition The Committee notes the Government’s report received in November 2012 in reply to the 2007 direct request. The Government indicates that it will keep the Committee informed with respect to the denunciation of the Convention. In its previous reports, the Government indicated that, as a landlocked country, the conditions for implementing the Convention in Afghanistan do not exist. It also indicated its intention to denounce the Convention after the approval by Cabinet and the National Assembly. The Committee recalls that, since the ratification of the Convention, it has never been possible to examine a detailed report on its application. It invites the Government to keep it informed of the denunciation of the Convention.
The Committee notes the Government’s reply received in April 2007 reiterating that, as a landlocked country, the conditions to implement the Convention in Afghanistan do not exist. The Government indicates that there are no dockworkers in the country and it intends to denounce the Convention after the approval by Cabinet and the National Assembly. The Committee notes again that, since the ratification of the Convention, it has never been possible to examine a detailed report on its application. It invites the Government to keep it informed of the denunciation of the Convention.
1. The Committee notes the Government’s statement contained in the report received in June 2006 indicating that, as a landlocked country, the conditions to implement the Convention in Afghanistan do not exist. In consultation with the different ministries and social partners, the Government intends to denounce the Convention.
2. The Committee further notes the observation by the National Union of Afghanistan Workers, forwarded with the Government’s report, indicating that, along the Amo River there is some seasonal port activity. The observation of the National Union also indicated that the Government should take measures to improve the social and political conditions of the portworkers.
3. The Committee notes that, since the ratification of the Convention, it has never been possible to examine a detailed report on its application. In view of the ongoing consultations, it invites the Government to provide the information requested in the report form on the Convention and to keep it informed of the denunciation of the Convention.

It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its direct request of December 1995, which read as follows:

The Government indicates that, after having been reviewed, the draft regulations will be submitted to the competent authorities for adoption. The Committee reiterates its hope that the draft regulations to which the Government has been referring over a number of years will be adopted in the near future and asks the Government to supply a copy of these regulations as soon as they are adopted. It also trusts that the Government will not fail to supply a full report on the application of the Convention in the form approved by the Governing Body, together with copies of relevant laws, regulations, etc., by which the Convention is applied.

It notes, in particular, the Government's statement to the effect that dock workers are government employees employed on a permanent basis and come under regulations applying to other government employees.
Further to its previous comments, the Committee asks the Government to indicate, in its next report, whether it still intends to adopt the regulations concerning the application of the Convention drafted by the Ministry of Commerce, to which the Government referred in its reports of 1990 and 1991. The Committee can but reiterate its hope that the Government will not fail to supply a full report on the application of the Convention in the form approved by the Governing Body, together with copies of the relevant laws, regulations, etc., by which the Convention is applied.

Further to its previous comments, the Committee notes from the Government's report that the Ministry of Commerce has completed the draft regulation concerning the application of the Convention which is going to enter into force in the near future. The Committee therefore asks the Government to supply a copy of this regulation as soon as it is adopted. It also reiterates its hope that the Government will not fail to supply a full report in the form approved by the Governing Body in the near future.
