CMNT_TITLE

Noting with regret that the Government has not submitted a report on the application of these Conventions, the Committee recalls that, in the context of the Standards Review Mechanism, in accordance with the recommendation of the Special Tripartite Committee established under the Maritime Labour Convention, 2006, as amended (MLC, 2006), the ILO Governing Body classified Conventions Nos 22 and 23 as “outdated”. At its 343rd Session (November 2021), the Governing Body placed an item concerning the abrogation of Conventions Nos. 22 and 23 on the agenda of the 118th Session (2030) of the International Labour Conference. The Committee also notes that, in January 2023, the Government requested the technical assistance of the Office in relation to the possible ratification of the MLC, 2006, and that exchanges have taken place to provide the technical assistance requested. In this context, the Committee requests the Government to provide information on any developments regarding the eventual ratification of the MLC, 2006.

Further to its previous comments, the Committee notes with interest that, according to the information supplied by the Government in its report, the new Maritime Code has been approved by the National People's Assembly and that it is presently under print and a copy of it will be transmitted to the ILO as soon as possible.

Further to its previous comments, the Committee notes from the Government's report that the committee of experts of the Standing Committee of the People's Assembly, which was responsible for preparing the draft amendments to the Maritime Code, has not yet completed its work due to other urgent matters. The Committee also notes that the competent minister has requested the committee to bring the Maritime Code rapidly into complete conformity with the Convention. The Committee therefore trusts that these amendments will be adopted by the Assembly in the very near future, in order to give effect to Article 6, paragraph 3 (10(c)), Article 9, paragraphs 1 and 2 and Articles 4, 8, 13 and 14 of the Convention.
