Article 5 of the Convention. Distribution of hours of work over a period longer than a week. Further to its previous comment, the Committee notes the Government’s indication that the Decree of 29 October 1957 regulating the limitations on hours of work established by labour laws for industry, commerce, and offices is still in force. Recalling that section 12 of that Decree allows for the averaging of hours of work over a period longer than a week, the Committee requests the Government to provide more detailed information on the conditions under which, and the limits within which, any such averaging may have been authorized.
Article 6. Permanent and temporary exceptions. The Committee notes that under sections 5 and 6 of Act 15.996 of 17 November 1988, which the Government has indicated that is still in force, the maximum number of authorized overtime is eight hours per week, except when the Ministry of Labour, after consulting the employers’ and workers’ organizations concerned and only for well-founded reasons, grants permission to exceed that weekly limit. Noting that Act 15.996 does not set daily and annual limits to authorized overtime hours, nor does it specify the circumstances under which the Ministry of Labour may grant permanent or temporary derogations from the eight-hour weekly limit, the Committee requests the Government to provide additional explanations on the manner in which overtime work is regulated in law and in practice.
