The National Industrial Policy Framework (NIPF) adopted by Government in 2007 provides the more general industrial policy framework for IPAP and the blueprint for Government's collaborative engagement with its social partners from business, labour and civil society.

Part 2 regulates application for mental health care and assessment. Part 3 provides for appeals against decisions of head of health establishment. Part 4 deals with transfer and discharge; Part 5 with surgical procedures and medical or therapeutic treatment. Part 6 provides for maximum security facilities, Part 7 for records, Part 8 for observations, and Part 9 for authorisation and licensing. Part 10 deals with educational programmes, and Part 11 with care administration of property of mentally ill person or person with severe or profound intellectual disability.

Divided into 17 parts. Part 1 contains foreword. Part 2 defines aims of code; Part 3 status of code. Part 4 sets forth legal framework; Part 5 definition of people with disabilities. Part 6 provides for accomodation of people with disabilities. Part 7 deals with recruitment and selection, Part 8 with medical and psychological testing, Part 9 with placement, Part 10 with training and career advancement, Part 11 with retraining of people with disabilities, Part 12 with termination of employment, Part 13 with workers' compensation, Part 14 with confidentiality and disclosure of disability, Part 15 with employee benefits, Part 16 with employment equity planning in respect of people with disabilities, and Part 17 with education and awareness.

Establishes the Social Plan Technical Support Facility in order to implement the sets of measures. Outlines Ministerial Notification and Department of Labour services. Contains financing provisions.

    Notice of Code of Good Practice on Dismissal Based on Operational Requirements (Notice 1517 of 1999).

    Establishes a code of good practice for dismissals based on operational requirements. Places procedural and substantive obligations on employers. Requires affected parties to conduct consultation proceedings in order to attempt to reach consensus on appropriate measures to avoid dismissals. Provides for the disclosure by the employer of information on matters relevant to the consultation. Sets criteria for the consultation process. Confirms employees' entitlement to severance pay. Establishes that employees dismissed for operational reasons should be given preference if the employer wishes to hire employees with comparable qualifications again.

    Amends the Aged Persons Act, 1967 to provide for conditions regarding subsidies for managers of registered old-age homes and for monitoring of these conditions. A new s. 3C prohibits discrimination with regard to admission to old-age homes; a new s. 6A requires medical care providers to notify authorities if they suspect that someone had suffered abuse in an old-age home. S. 6B prohibits the abuse of an aged person.

    Mines and Works Amendment Act, 1991. No. 13.

    Amends the Mines and Works Act, 1956, in order to further regulate the circumstances in which women may work at mines or works; to provide for more severe penalties to be prescribed in the relevant regulations for contravention thereof or failure to comply therewith; to increase certain penalties under the said Act; to declare certain negligent acts offences; and to provide for matters connected therewith. Section 11 of the 1956 Act, as amended, now provides that "No person under the age of 16 years shall work underground in a mine, and nobody shall cause or permit any such person so to work". The same applies to women, subject to four exceptions covering women in managerial positions not performing manual work, those in health or welfare services, those having to spend a period underground in a mine for training or research purposes in the course of their studies, and those occasionally having to go in a mine for the purposes of a non-manual occupation. Section 15 of the same Act is amended to make stricter provisions for occupational health and safety in mines.

    Temporary Removal of Restrictions on Economic Activities Act 1986. No. 87.

    Empowers the President to suspend temporarily laws or conditions thereunder with regard to certain undertakings, industries, trades or occupations, or to grant temporary exemptions, if circumstances exist so that the application of those laws or conditions unduly impede economic progress or the creation of job opportunities. Proclamations of this nature require the advice of the Standing Committee established by the Act, after consultation with the Minister of Manpower, when the following matters are involved: registration of employees and of factories, factory inspection, conditions of service and working hours, use of machinery, and health and safety protection. The Act shall cease to have effect on 31 Mar. 1989.

    The decision refers to the special work-creation programme announced in October 1985. Employers engaging persons in approved projects under the programme are exempted from compliance with the basic conditions of employment as regards minimum wages, annual and sick leave, piece work and commission work and termination of employment. The decision was taken by the Director-General for Manpower.
