Mines and Works Amendment Act, 1991. No. 13. Adoption: 1991-03-18 | Date d'entrée en vigueur: 1991-04-03 | ZAF-1991-L-22403 Amends the Mines and Works Act, 1956, in order to further regulate the circumstances in which women may work at mines or works; to provide for more severe penalties to be prescribed in the relevant regulations for contravention thereof or failure to comply therewith; to increase certain penalties under the said Act; to declare certain negligent acts offences; and to provide for matters connected therewith. Section 11 of the 1956 Act, as amended, now provides that "No person under the age of 16 years shall work underground in a mine, and nobody shall cause or permit any such person so to work". The same applies to women, subject to four exceptions covering women in managerial positions not performing manual work, those in health or welfare services, those having to spend a period underground in a mine for training or research purposes in the course of their studies, and those occasionally having to go in a mine for the purposes of a non-manual occupation. Section 15 of the same Act is amended to make stricter provisions for occupational health and safety in mines.

Adoption: 1988-04-15 | ZAF-1988-L-6538 Provides for certain matters relating to the conditions of service of employees of the South African Transport Services (categories of employment, salary adjustments, employment injury compensation, non-discrimination on the basis of colour, race or sex in appointments (s. 3(7)), discipline, etc.). Establishes the Labour Council, the objects of which are to maintain and promote labour peace and prevent labour disputes by means of collective bargaining, referral to mediation, arbitration or other procedure (s. 8). Strikes are prohibited (s. 21). Repeals, inter alia, the Conditions of Employment (South African Transport Services) Act 1983.

South African Transport Services Amendment Act 1987. No. 91. Adoption: 1987-10-16 | ZAF-1987-L-4635 Amends s. 26 of the Conditions of Employment (South African Transport Services) Act 1983 so as to provide for steps which may be taken by the General Manager in case of an illegal strike (including termination of an employee's service) and inserts s. 32A in that Act for the purpose of achieving parity in service conditions for employees of all races. Also amends s. 1 and repeals s. 16 of the Railway and Harbours Pensions for Non-Whites Act 1974 for the purposes of having parity in pension benefits for all races. In addition, amends ss. 4 and 9 of the South African Transport Service Act 1981 regarding other functions.

They revoke specified portions of Regulations published in Government Notices Nos. R. 929 of 28 June 1963 and R. 1934 of 13 Dec. 1963, both as amended.

Mines and Works Amendment Act 1987. No. 38. Adoption: 1987-09-02 | ZAF-1987-L-4624 Amends the Mines and Works Act 1956 in relation to the regulatory powers of the Minister. In particular, refers to requirements for certification of competency with a view to safety and health at mines or works ("provided that no distinction shall be made on the basis of race or colour" (new s. 12(nA)) and the permissible number of hours or shifts which employees with a view to safety and health may work. Adds a new subsection (2) to section 12 stating that the Minister shall consult with any employees' or employers' organisation which in the Minister's opinion has an interest in the composition of certain committees.

Temporary Removal of Restrictions on Economic Activities Act 1986. No. 87. Adoption: 1986-09-03 | ZAF-1986-L-2848 Empowers the President to suspend temporarily laws or conditions thereunder with regard to certain undertakings, industries, trades or occupations, or to grant temporary exemptions, if circumstances exist so that the application of those laws or conditions unduly impede economic progress or the creation of job opportunities. Proclamations of this nature require the advice of the Standing Committee established by the Act, after consultation with the Minister of Manpower, when the following matters are involved: registration of employees and of factories, factory inspection, conditions of service and working hours, use of machinery, and health and safety protection. The Act shall cease to have effect on 31 Mar. 1989.

Adoption: 1985-10-25 | ZAF-1985-L-1999 The decision refers to the special work-creation programme announced in October 1985. Employers engaging persons in approved projects under the programme are exempted from compliance with the basic conditions of employment as regards minimum wages, annual and sick leave, piece work and commission work and termination of employment. The decision was taken by the Director-General for Manpower.
