    Replaces the Prevention of Family Violence Act, 1993. The Act comprises a substantial broadening of the limited scope of the 1993 - Act, and recognises that domestic violence is a serious social evil and an obstacle to achieving gender equality. The Act offers protection to any victim of domestic violence who is in a domestic relationship with an abuser. A broad definition has been given to "domestic violence", so as to include any form of abuse and not only physical abuse. The Act places a duty on a member of the Police Service to inform a victim of his or her rights at the scene of the incident of domestic violence. Provision is also made for the National Commissioner of the South African Police Service to issue national guidelines which must be observed when dealing with domestic violence, and failure to comply with these guidelines will result in disciplinary proceedings against the member concerned.

    Permits consensual sterilisation of persons above the age of 18. Persons not capable of consenting (as in the case of mental disability) may be sterilised with the consent of a parent, spouse, guardian, or curator, and with the approval of a specified medical panel.

    Allows the President, subject to art. 34 of the Constitution, to declare a state of emergency to deal with national disaster, war or general insurrection. Regulations made pursuant to a declaration of a state of emergency expire if the state of emergency is lifted or the regulation is revoked by the National Assembly. No regulation made under the state of emergency may affect the election or tenure of members of Parliament or provincial legislatures.

    Provides comprehensive legislation for the investigation of and rehabilitation and recompensation for human rights violations committed from 1 March 1960 to the cut-off date contemplated in the Constitution, within or outside of the Republic of South Africa. Chapter 2 establishes a Truth and Reconciliation Commission with the purpose of providing a comprehensive account of violations, establishing the fate of victims, and facilitating amnesty for persons willing to make a full disclosure about human rights violations. Chapter 3 establishes a Committee on Human Rights Violations with the purpose of investigating violations and making recommendations to the Commission. Chapter 4 provides for regulations on the granting of amnesty, including the establishment of a Committee on Amnesty. Amnesty is to be granted to individuals who make a full disclosure and who were acting, with a political objective, on behalf of a publicly known liberation movement or state security forces. Chapter 5 establishes a Committee on Reparation and Rehabilitation.

In order to eliminate discriminatory legislation, remove impediments to free political activity, and promote the objects of the Transitional Executive Council, this Act empowers the State President to repeal and amend certain laws in force in the Republic or in any area of the Republic, including self-governing territories.
