The Civil Procedure Code of the State of Eritrea provides the mechanism by which persons access courts for the proper determination and enforcement of their rights and duties. It regulates the process courts should follow in adjudicating civil and commercial disputes.

The Code, as a means to reach substantive justice, incorporates rules and principles with the end of ensuring both substantive and procedural justice in the judicial process. To this end, this Code provides equal and fair treatment of parties to a dispute by putting in place provisions which afford reasonable and equal opportunities at every stage of the process. It aims to govern the litigation process to an extent which leaves little or no room for any arbitrariness in exercising judicial discretion thereby ensuring fairness and justice.

Regulations for the Importation, Handling, Use, Storage and Disposal of Pesticides (L.N. No. 114 of 2006). -

These Regulations introduce measures of control on the importation and placing on the market of pesticides. Only pesticides listed in Annex 1 to these Regulations may be imported commercially. Other pesticides may be imported for scientific purposes. Importation of pesticides requires a pesticide import permit and importation or otherwise trading or commercial application of pesticides requires a pesticide dealers license.
Other provisions of these Regulations concerning packaging and labelling of pesticides and testing by importers and inspection by the Ministry. The Ministry shall issue a document of qualification to approved importers and dealers.

Factory Vessel Regulations (L.N. No. 67/2003). -

These Regulations lay down the hygienic conditions that shall apply to handling (slaughtering, freezing, processing, salting, packing, etc.) of fish products on board of factory vessels Article 3 sets out minimum requirements for design and equipment. Article 4 prescribes design of areas for preparation and processing and freezing of fishery products. Article 6 prescribes requirements for vessels on which fish is frozen. A qualified person on board of a factory vessel shall be responsible for implementing best practices. Article 10 defines hygienic conditions applicable to heading, gutting and filetting, canning, smoking, thawing, etc. of fish. Article 24 contains general conditions for visual inspection of fish products. (27 articles)

Part VI deals with wages, hours of work, leave, public holidays, working conditions of the disabled, working conditions of women and young employees, and employment injuries. Foreign Fishing Vessel Regulations (L.N. No. 38/1998). -

These Regulations make provision for the granting of fishing and other licenses to foreign fishing vessels, lay down some rules relative to operations of those vessels in Eritrean waters, and prescribe offences and penalties. No fishing license shall be granted to a vessel which is not registered with the Ministry of Fisheries (art. 3). The First Schedule provides a form of fishing license and the Second Schedule a form of a transshipment license. Article 5 concerns fees. Conditions that in general apply to operations of foreign fishing vessels are set out in article 6. Agents shall be appointed for each vessel for which an application for registration or granting of a license is made (art.7). Remaining provisions set out rules for operations of vessels such as the stowage of gear, disposal of waste matter, and the fitting out of vessels, regulate scienti8fic research (art. 17) and prescribe offences and penalties. The Third Schedule contains specifications for the marking of vessels. (22 articles)

National Fishing Vessel Regulations (L.N. No. 39/1998). -

These Regulations make provision for the granting of national and fishing to fishing vessels, lay down some rules relative to operations of those vessels in Eritrean waters, and prescribe offences and penalties. Vessels that are not motorized or motorized but not exceeding four meters of overall length and vessels used exclusively for recreation fishing shall not be required to operate under a license (art. 3). Applications for a national fishing vessel license shall be made to the Head of Department of the Ministry of Fisheries (art. 4). Article 6 makes provision with respect to fees. Article 7 specifies general conditions that apply to vessels operating under a national fishing vessel license. No spear guns shall be used (art. 10). Marine turtles are declared to be protected species under article 11. Chapter III provides for fundamental rights, freedoms and duties. Inter alia, prohibits discrimination based on race, ethnic origin, language, colour, gender, religion, disability, age, political views, or social or economic status; also prohibits forced labour and torture. Provides the right to due process of law and freedom of association (art. 19). Art. 27 allows the President to proclaim a state of emergency.

Mining Proclamation No. 68/1995. -

The Proclamation shall apply to all mining operations, i.e. acts carried out to prospect, explore and mine for minerals within the territory of Eritrea. No person may carry out any mining operations without a license granted under this Proclamation. A person applying for a right must be eligible in accordance with section 5. Certain criteria do not apply to persons wishing to acquire an Artisanal mining right (as defined in section 2). Any Eritrean may prospect without a license on land not already subject to an existing license or application for a license. The Government may designate areas reserved for or excluded form specified mining operations (sect. 6). Section 8 defines a prospecting license, whereas section 9 provide for exploitation licenses. Discoveries of existence of minerals shall be immediately notified to the Controller, i.e. a person appointed by the Licensing Authority to control mining operations (sects. 12 and 13). An Artisanal mining license may be granted in respect of a part of the surface of an area subject t an existing exploration license (sect. 14). Sections 16 and 17 deal with mining licenses. Mineral water may be used or produced in accordance with section 18. Sections 20 to 27 specify rights and obligations of licensees. The licensee may occupy land covered by the license during the term of the license. All types of licenses shall be issued by the Ministry of Energy, Mines and Water Resources acting as Licensing Authority (sect. 43). Section 45 deals with registration and representation of licensees. Section 48 concerns settlement of disputes.

Inter alia provides for obligations of licensee in the conduct of mining operations. Mining operations shall be conducted in such a manner as to ensure health and safety of his agents, employees and other persons, and to minimize damage or pollution to the environment. Also provides for inspection of mining operations. Section 45 establishes that the holder of a license may be required, on surrender of revocation, to fence and safeguard any pits and other works in the license area so that the health, life and property of persons may not be endangered.

Inter alia establishes obligation of holders of mining licenses to ensure health and safety at work. Section 30 provides that licensee shall provide his agents and employees with appropriate work clothing and protective equipment and shall ensure that they are properly trained or otherwise qualified for their work. Licensee is also obliged to provide appropriate health and medical facilities. Part VI deals with infractions and sanctions.

It is hereby proclaimed that the Maritime Code of 1960 Ethiopia hitherto in force shall, as of 15 September, 1991, serve as the Transitional Maritime Code of Eritrea with the following amendments and substitutions and with all words, phrases, names and dates denoting the Provisional Government of Eritrea. Except for the provisions of Article 46(1), the Maritime Code of Ethiopia of 1960 is hereby adopted and shall take effect. The provisions of Articles 2-5, Article 6(f) and (g) and Articles 28-31 of Proclamation No. 137 of 1953 as amended in 1956 are hereby adopted and shall take effect while the other provisions of the said Proclamation are hereby repealed. Relationship of this Transitional Maritime Code with other Colonial Laws All colonial laws which directly or indirectly contradict the provisions of this Transitional Maritime Code or which amend the provisions of the Maritime Proclamation or the 1960 Maritime Code of Ethiopia are hereby repealed.
