    “WHEREAS section 75 of the Constitution provides as follows:
    75 Right to education
    (1) Every citizen and permanent resident of Zimbabwe has a right to—
    (a) a basic State-funded education, including adult basic education; and
    (b) further education, which the State, through reasonable legislative and other measures, must make progressively available and accessible.
    (2) Every person has the right to establish and maintain, at their own expense, independent educational institutions of reasonable standards, provided they do not discriminate on any ground prohibited by this Constitution.
    (3) A law may provide for the registration of educational institutions referred to in subsection (2) and for the closing of any such institutions that do not meet reasonable standards prescribed for registration.
    (4) The State must take reasonable legislative and other measures, within the limits of the resources available to it, to achieve the progressive realisation of the right set out in subsection (1).

    The purpose of this Bill is to provide for the well-being of older persons, to provide for the appointment of a Director for Older Persons affairs, the establishment of an Older Person Board, to create an Older Persons Fund and to provide for matters connected therewith, or incidental thereto.

    In more detail, the individual clauses of the Bill provide as follows:
    Clause 1
    This clause gives the short title of the Bill and provide for the fixing of date of operation by President through a statutory instrument.

    Clause 2
    The terms used in this Bill are defined in this clause.

    Clause 3
    This clause establishes the office of Director for Older Persons Affairs who will be responsible for coordinating the activities of the Older Persons Board. The Director will perform his duties in accordance with such general directions as the Minister may issue from time to time.

    Clause 4
    This clause establishes the Older Persons Board and also provides for the appointment of members of the Board by the Minister. This clause also provide for the appointment of the Chairperson and Vice-Chairperson of the Board, the conditions of service for members of the Board and the procedure at meetings of the board.

    Clause 5
    This clause deals with disqualification for appointment as a member of the Board. In particular, persons not ordinarily resident in Zimbabwe will not qualify for appointment.

    Clause 6
    Termination of appointment as members of the Board is provided for by this clause. A member of the Board may resign voluntarily. The Minister is also empowered to terminate the appointment of any Board member in circumstances outlined in this clause.

    Clause 7
    The functions of the Older Persons Board are provided for by this clause. Basically the Board will be responsible for formulating and designing policies meant to ensure the well-being, care and protection of older persons. This clause also empowers the Board to set up committees to which certain of its functions may be delegated.

    Inserts new section 16A "Agricultural land acquired for resettlement and other purposes", a new section 33 on the Parliament and adds a new Part 2 in Chapter V entitled "The Senate".

    Amends sections 22 on "protection of freedom of movement", 23 on "protection from discrimination on the grounds of race, etc.", 31F on "vote of no confidence in Government", 38, 40, 40B, 41, 45 to 47, 52, 54, 61, 91, 113 and Schedules 3, 4 and 7.

    Amends sections 2, 2A, 3, 11, 12, 12B, 12C, 13, 18, 23, 25, 29, 30, 40, 45, 48, 51, 63, 74, 76, 79, 81, 86, 89, 92A, 93, 98, 106, and 107 of the principal Act and repeals sections 22 and 97. It also substitutes new text into sections 19 and 83 and inserts new sections 82B (administration of Part XI), 90A (procedure and evidence in the Labour Court), and 92D (appeals to the Labour Court no provided for elsewhere in this Act). The Act also repeals section 56 of the Export Processing Zones Act [Chapter 14:07].

    Provides for the Registrar General of Voters and constituency registrars. Makes provision for the registration of voters and for the lodging of objections thereto. Provides for the preparation, compilation and maintenance of voters rolls as well as the functions of the
    Zimbabwe Electoral Commission with respect to observers. Prescribes the residence qualifications of voters and the procedure for the nomination and election of candidates to and the filling in of vacancies in Parliament as well as the elections to the office of the President and local authority elections. Contain offences and penalties, and provides for the prevention of electoral malpractices in connection with elections. Establishes the Electoral Court and provide for its functions and make provision for the hearing and determination of election petitions.

    Repeals the Electoral Act [Chapter 2:01].

    Sets out the Labour Officer's role in conciliation and in referring matters to arbitration. Also sets out regulations for the representation of parties, procedures after reference to arbitration and voting by secret ballot when employees or employers have decided to resort to collective job action to resolve disputes in terms of section 104 of the Labour Act.

    Repeal the Labour Relations (Settlement of Disputes) Regulations, 1993 (S.I. 30 of 1993).

    Labour Relations (Retrenchment) Regulations, 2003 (S.I. 186 of 2003).

    Regulates the retrenchment of less than 5 employees in any six month period including the giving of notice, the establishemnt of a Retrenchment Board and approval of retrenchment. These Regulations repeal the Labour Relations (Retrenchment) Regulations, 2003 (S.I. 132 of 2003). Retrenchments of 5 employees and over are dealt with under sections 12C and D of the Labour Act.

    Labour Relations (Protection Against Any Acts of Interference Between Workers' Orgnisation and Employers' Organisation) Regulations, 2003 (S.I. 131 of 2003).

    Defines "workers' organisation" in the regulations as a trade union, staff association or worker's committee as defined by the Labour Relations Act. Workers' and employers' organisations shall enjoy adequate protection against any acts of interference by each other or each other's agents or members in their establishment, functioning or administration. No employer or employers' organisation shall interfere with a workers' organisation or its agents or members with respect to the establishment, functioning or administration of the workers' organisation.
    It shall be considered an act of interference for an employer or employers' organisation to promote or finance a workers' organisation under the domination of the employer. Offenders against the regulation shall be liable to a fine or imprisonment.

    Regulates application for registration of mass media services and news agencies, as well as application for accreditation of journalists. Also provides for application for renewal of registration and accreditation and for levy payable to Media and Information Fund. Schedules contain prescribed forms for application.

    Labour Relations (Terminal Benefits and Entitlements of Agricultural Employees Affected by Compulsory Acquisition) (Amendment) Regulations, 2002 (S.I. No. 101 of 2002).

    Provides for establishment of Agricultural Employees' Compensation Committee. A function of Committee shall be to determine what terminal benefits and entitlements, if any, are due to any employee of an employer in respect of whom Committee received notification of payment of compensation for land compulsorily acquired.
