Makes provision for, inter alia, accident notification, establishment of plans of mines and tunnels, operations records, examinations of mines and tunnels, visits to solitary employees, testing for flammable gas and withdrawal of employees when high levels of flammable gas are present, provision of self-rescue units and outlets for working, protection against inundation, air quality and temperature, and handling of explosives. State Sector Act 1988 (1988, No. 20). - Adoption: 1988-03-30 | NZL-1988-L-6304 The purposes of the Act include promoting efficiency in state services, providing for the negotiation of conditions of employment in those services and promoting equal employment opportunities. Part I sets forth the duties, functions and powers of the State Services Commission; Parts II, III and IV address the public service and its executive posts. In Part V, entitled Personnel Provisions, the general principles for ensuring that each department shall be a good employer are set forth (including good and safe working conditions and an equal employment opportunities programme, with specific reference to minorities, women and disabled persons). Part VI governs the application of the Labour Relations Act 1987 (LS 1987 - NZ 1), which, except as otherwise provided, is to apply in relation to the public service; negotiations, compulsory arbitration and agreements not to strike or lock-out are specifically addressed in this Part. Provisions on the same topics regarding the education service appear in Part VII. The State Services Act 1962, the State Services Conditions of Employment Act 1977 and the Health Service Personnel Act 1983 are repealed.

Agricultural Workers Amendment Act 1987. No. 78. Adoption: 1987-05-27 | NZL-1987-L-3558 These amendments to the Agricultural Workers Act 1977 (LS 1977 - NZ 1) repeal its Parts II (classes of agricultural workers), III (agricultural tribunal) and IV (settlement of disputes), along with its First Schedule. Henceforth, those matters are to be dealt with under the Industrial Relations Act 1987 (No. 77). This amendment Act also repeals s. 9 of the Agricultural Workers Act, ss. 2, 3 and 5 of, and the Schedule to, the Agricultural Workers Amendment Act 1977, and the Agricultural Workers Amendments Acts of 1979, 1980, 1982, 1984 and 1985. It also revokes the Industrial Relations Amendment Act Commencement Order 1978 (S.R. 1978/99) and the Agricultural Workers (Workers' Organisation Membership) Regulation 1985 (S.R. 1985/155). Finally, the amendments revise s. 2 (definition of "worker" and "employer") and ss. 6(l)(f), 59 and 60 (minor changes) of the Agricultural Workers Act.

Agricultural Workers Amendment Act 1985. Adoption: 1985-06-18 | NZL-1985-L-1843 The Act deals with workers' organisation membership clauses. As a basic principle, it provides that such clauses must be inserted in an award or agreement lodged with the Registrar for industrial relations; the clause will otherwise have no legal effect. The insertion, maintenance or reinstatement of such a clause must be supported by 50 per cent at least of the valid votes cast by the agricultural workers concerned. The statute details voting conditions and procedures. If all the necessary conditions are fulfilled and a certificate to that effect has been issued by the Registrar, a workers' organisation membership clause will be incorporated into all the relevant agreements or regulations and will remain in effect for three years; the clause will otherwise not be inserted, or be invalidated. The insertion or non-insertion of the clause remains subject to judicial review. A valid clause will put the workers under an obligation to join the representative organisation, as they will otherwise be liable to a fine, and the organisation under an obligation to accept their membership. By the same token, it puts the employer under an obligation to employ only workers who are members of the organisation; failure to do so will make him liable to a fine. The Act repeals and replaces sections 15A to 15L of the Agricultural Workers Act 1977 which was published in the Legislative Series (LS 1977 - NZ 1). (Note: this 1985 Amendment was repealed by the Agricultural Workers Amendment Act 1987 (No. 78).)
